About public service of the Republic of Kazakhstan

Chapter 1. Basic provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) managerial state positions of the case "A" - the managerial state positions of managerial level provided by this Law and the register of positions of the political, elected and administrative government employees for which are provided special procedure for receipt, passing and termination of public service of the Republic of Kazakhstan, and also special qualification requirements;

2) the administrative government employee - the government employee performing the activities on permanent professional basis on managerial state positions of cases "A" and "B" on accomplishment of ex-officio full powers in the state bodies, except as specified provided by the laws of the Republic of Kazakhstan and acts of the President of the Republic of Kazakhstan;

3) category of managerial state position - set of managerial state positions according to the register of positions of the political, elected and administrative government employees;

4) the leading state position (further - executive position) - the state position under which supervision government employees and given authority on the organization of their activities are;

5) managerial state positions of the case "B" - the managerial state positions provided by the register of positions of the political, elected and administrative government employees, providing organizational, legal, information, analytical, financially economic and other functional maintenance of activities of state bodies, realization of functions and tasks of the state within powers of the relevant state body and which are not relating to managerial state positions of the case "A";

6) bonus - the money payment established to the government employee by results of assessment of its activities according to the procedure, established by the legislation of the Republic of Kazakhstan;

7) qualification requirements - the requirements by training, to work experience and competences shown to the citizens of the Republic of Kazakhstan applying for occupation of the state position;

8) workplace - structurally allocated and organized place of permanent or temporary finding of the government employee and intended for accomplishment of ex-officio full powers by it including equipped and organized taking into account individual opportunities of person with disability;

9) the veteran of public service of the Republic of Kazakhstan - person having years of service of public service at least twenty five years, with faultless reputation, reached retirement age according to the Social code of the Republic of Kazakhstan or stay of which in public service on reaching retirement age is extended according to this Law;

10) public service of the Republic of Kazakhstan (further - public service) - professional activity of the citizens of the Republic of Kazakhstan holding paid state positions in state bodies and performing the ex-officio full powers directed to realization of functions and tasks of the state and (or) powers of state bodies according to the appointment and features of public service provided by this Law and other regulatory legal acts of the Republic of Kazakhstan;

11) office need - the circumstances or conditions requiring temporary change of nature or amount of work, working conditions of the government employee for ensuring uninterrupted and effective implementation of powers of state body;

12) the official - person, is permanent, temporary or on special power performing functions of the public agent or performing organizational and administrative or administrative functions in state bodies;

13) ex-officio full powers - the rights and obligations provided by specific state position, answering to the purposes and tasks facing state bodies in which government employees perform the activities;

14) personnel reserve of public service - the list of the citizens of the Republic of Kazakhstan having necessary professional and personal qualities created in accordance with the established procedure, intended for the subsequent occupation by them vacant state positions and also completions of state bodies by the necessary number of qualified specialists;

15) the government employee - the citizen of the Republic of Kazakhstan borrowing in the procedure established by the legislation of the Republic of Kazakhstan paid from means republican or local budgets or from means of National Bank of the Republic of Kazakhstan and (or) the Special state fund determined by the legislation of the Republic of Kazakhstan on return to the state of illegally acquired assets, the state position provided by the register of positions of the political, elected and administrative government employees, and also other regulatory legal acts of the Republic of Kazakhstan, and performing ex-officio full powers on realization of functions and tasks of the state;

16) office ethics of government employees (further - office ethics) - the rules of conduct of government employees established by this Law and the Ethical code of government employees of the Republic of Kazakhstan, providing ethical principles and standards of office ethics;

17) competence of the government employee - set of knowledge, skills necessary for effective implementation of professional activity on specific state position;

18) the direct head of the government employee - person, higher on the state position, in relation to whom the government employee is under direct supervision according to its job description;

19) authorized body for public service (further - authorized body) - the central state body enabling the realization of single state policy in the field of public service;

20) the state position - structural established post of state body to which the circle of ex-officio full powers established by regulatory legal acts of the Republic of Kazakhstan for direct execution of functions and tasks of the state and (or) powers of state bodies is assigned, and also included in the register of positions of the political, elected and administrative government employees;

21) the head of state body - the head of the central state body, its department, their territorial subdivisions, the head of the executive body financed from the local budget, the chairman of audit committee, the chief of staff which is state body in the cases established by the laws of the Republic of Kazakhstan;

22) the contractual employee of state body (further - the contractual employee) - the citizen of the Republic of Kazakhstan attracted in state body under the contract with the features provided by this Law to implementation of national and other projects which types are determined by the Government of the Republic of Kazakhstan;

23) the contract of the contractual employee of state body - the employment contract between state body and the citizen of the Republic of Kazakhstan establishing its rights and obligations, working conditions, and also the work payment terms interconnected with results of work (quantitative and (or) qualitative indexes), responsibility for not achievement of results of work (quantitative and (or) qualitative indexes) and other individual conditions;

24) the state digital personnel system - the state digital system intended for collection, storage, processing, use, transfer and the analysis of information about government employees and employees of the subordinated organizations of state bodies, implementation of management functions by personnel and also monitoring of compliance with law of the Republic of Kazakhstan;

25) the chosen state position - the akim's position to which the citizen of the Republic of Kazakhstan is elected on the basis of general, equal and direct suffrage in case of secret vote according to the Constitutional law of the Republic of Kazakhstan "About elections in the Republic of Kazakhstan";

26) the elected government employee - the citizen of the Republic of Kazakhstan holding the chosen state position;

27) the political government employee - the person appointed to position and dismissed by the President of the Republic of Kazakhstan, the Government of the Republic of Kazakhstan or Kurultai of the Republic of Kazakhstan, other persons (bodies) according to the Constitution of the Republic of Kazakhstan and the laws of the Republic of Kazakhstan who participates in forming and (or) realization of state policy and bears political responsibility for achievement of its purposes and tasks;

28) local position - managerial state position of the case "B" which according to the staff list of state body is subordinate state position;

29) temporarily vacant state position - the state position, free on absence period of the government employee holding this state position in connection with posting, stay on social leave or on training, temporary discharge from execution of ex-officio full powers, application concerning it according to the criminal procedure legislation of the Republic of Kazakhstan of measure of restraint in the form of house arrest or detention, absence from work more than two months in a row owing to disease if the disease is included into the list of diseases for which longer term of disability approved by authorized body in the field of health care is established;

30) the allowance - the cash surcharge to official pay rate established to the government employee according to the procedure, determined by the legislation of the Republic of Kazakhstan;

31) the staff list - the document establishing organizational structure, structure and number of the state positions of state body;

32) posting - occupation the government employee of the state position in other state body, foreign institution of the Republic of Kazakhstan and position in other organization according to the procedure established by the legislation of the Republic of Kazakhstan.

Article 2. The legislation of the Republic of Kazakhstan in the field of public service

1. The legislation of the Republic of Kazakhstan in the field of public service is based on the Constitution of the Republic of Kazakhstan and consists of the Labor code of the Republic of Kazakhstan, this Law, other regulatory legal acts of the Republic of Kazakhstan.

2. Operation of this Law extends on:

1) all government employees, except as specified, when the Constitution of the Republic of Kazakhstan, by the constitutional laws or other laws of the Republic of Kazakhstan for them determines other legal status;

2) the citizens of the Republic of Kazakhstan arriving on service in law enforcement agencies and bodies of civil protection regarding passing of testing and personal evaluation;

3) the political government employees serving in special types of public service including law-enforcement service, service in special state bodies, military service, service in bodies of civil protection, with the features provided by the laws of the Republic of Kazakhstan;

4) political government employees of National Bank of the Republic of Kazakhstan and authorized body on regulation, control and supervision of the financial market and the financial organizations with the features provided by the laws of the Republic of Kazakhstan;

5) the citizens of the Republic of Kazakhstan consisting in personnel reserve of public service and the citizens of the Republic of Kazakhstan having training for revenues to public service in the part settled by this Law;

6) persons performing assistance in realization of functions and tasks of the state, and also the faces performing activities in state bodies based on the employment contract in the part settled by this Law.

Article 3. Purpose and tasks of this Law

1. The purpose of this Law is regulation of the public relations in the field of public service, and also the public relations connected with assistance in realization of functions and tasks of the state.

2. Tasks of this Law are:

1) determination of appointment of public service, its features and bases of execution of public service;

2) regulation of the status, the rights, obligations, responsibility, legal, social and other guarantees of government employees, and also other persons in the field of public service;

3) establishment of the legal basis of revenues to public service, its passings and terminations;

4) determination of organizational bases of personnel management of public service, procedure of the state control of compliance with law of the Republic of Kazakhstan in the field of public service, and also monitoring and the analysis of causes of infringement of the legislation of the Republic of Kazakhstan in the field of public service.

Article 4. The principles of the legislation of the Republic of Kazakhstan in the field of public service

1. The legislation of the Republic of Kazakhstan in the field of public service is based on the principles:

1) legality - activities of government employees are performed in strict accordance with the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan and other regulatory legal acts of the Republic of Kazakhstan, and also in case of their strict observance;

2) priority of rights and freedoms of man and citizen - the rights and freedoms of man and citizen of the Republic of Kazakhstan guaranteed by the Constitution of the Republic of Kazakhstan and the laws of the Republic of Kazakhstan are recognized the supreme value and are subject to observance and protection from government employees;

3) accountabilities, submission to control and responsibility - government employees are accountable to society, are under control to higher state bodies and officials, shall perform their decisions made according to the Constitution of the Republic of Kazakhstan and the laws of the Republic of Kazakhstan and within the ex-officio full powers bear responsibility for the decisions, actions or failure to act in the limits set by the Constitution of the Republic of Kazakhstan and the laws of the Republic of Kazakhstan;

4) the equal right to access to public service - the equal right to access to public service in case of compliance to conditions of revenues to public service is provided to citizens of the Republic of Kazakhstan;

5) transparency of procedures - procedures of selection on public service and career promotion shall be transparent, objective and provide equal opportunities for all citizens of the Republic of Kazakhstan;

6) meritocracy - selection of citizens of the Republic of Kazakhstan on public service is performed on the basis of their professional competences, efficiency of accomplishment of job responsibilities, compliance to qualification requirements;

7) prohibition of abuse of formal requirements - the official is forbidden to perform the actions directed to refusal in realization, restriction or the termination of the rights of physical persons and legal entities and also on establishment and presentation of requirements only for the formal bases if such bases do not interfere with consideration of matter of substance;

8) continuity of professional development of government employees - government employees on permanent basis are trained for the purpose of increase in competences of the government employee and ensuring effective implementation of the job responsibilities assigned to them;

9) legal and social security - government employees are provided with compensation guarantees, social and compensation payments, provision of pensions, legal protection, and also other types of material, social and legal support, stipulated by the legislation the Republic of Kazakhstan;

10) other principles established by the laws of the Republic of Kazakhstan.

Article 5. Public service and its unity

1. Public service constitutes the single system of state bodies combined by mechanisms of the approved functioning and interaction for ensuring effective implementation of functions and tasks of the state according to the legislation of the Republic of Kazakhstan.

2. The unity of system of public service of the Republic of Kazakhstan is based on:

1) unitary structure of the state;

2) to the single system of legal regulation based on the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan and other regulatory legal acts of the Republic of Kazakhstan;

3) the approved functioning and interaction of state bodies, their responsibility and accountability;

4) differentiation of competences between state bodies and powers between government employees;

5) preserving the status of the government employee in case of its official movement;

6) financing and material logistics at the expense of means republican or local budgets or from means of National Bank of the Republic of Kazakhstan and (or) the Special state fund determined by the legislation of the Republic of Kazakhstan on return to the state of illegally acquired assets if additional sources of financing are not established by the laws of the Republic of Kazakhstan.

3. Public service also includes its special types:

1) law-enforcement service according to the legislation of the Republic of Kazakhstan on law-enforcement service;

2) military service according to the legislation of the Republic of Kazakhstan on military service and the status of the military personnel;

3) service in special state bodies according to the legislation of the Republic of Kazakhstan on special state bodies;

4) service in bodies of civil protection according to the legislation of the Republic of Kazakhstan on civil protection;

5) the public courier service according to the legislation of the Republic of Kazakhstan on the state courier communication.

Chapter 2. Appointment and execution of public service

Article 6. Appointment and features of public service

1. Appointment and at the same time the mission of public service are realization of functions and tasks of the state according to the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan and other regulatory legal acts of the Republic of Kazakhstan, ensuring realization of the rights, freedoms and legitimate interests of man and citizen of the Republic of Kazakhstan, and also quality and availability of provision of the state services by it.

2. Appointment of public service includes the following directions:

1) ensuring protection of labor rights of citizens of the Republic of Kazakhstan, labor protection, implementation of measures on social and to provision of pensions, social insurance, provision of special social services, and also social support of socially vulnerable categories of citizens of the Republic of Kazakhstan;

2) ensuring realization of the rights of citizens of the Republic of Kazakhstan to health protection, prevention of diseases, ensuring availability and guarantees of provision of medical services, requirements satisfaction of citizens of the Republic of Kazakhstan in effective, high-quality and available medicines;

3) ensuring realization of the rights of citizens of the Republic of Kazakhstan to receipt of the guaranteed secondary education which is not paid with them, provision of quality and available education at all levels, protection of the rights and legitimate interests of children, development of science and technology;

4) ensuring environmental protection, ecological safety of the country, rational use and recovery of natural resources, managements of the woods which are especially protected by the natural territories and protection, reproduction and use of fauna;

5) ensuring protection, rational use and recovery of water resources of the country, ensuring requirements of the population and industries of economy in water, safety of water fund and protection of waters against pollution, contamination and depletion;

6) ensuring tourism development, mass and professional sport, availability of sporting events to all segments of the population;

7) ensuring support and cultural development, development state and other languages, the information sphere, public institutes, and also ensuring realization of state policy in the field of religious activities;

8) ensuring development of agro-industrial complex, aquaculture, seed farming, grain crops and quarantine of plants, breeding livestock production, veterinary science and beekeeping;

9) ensuring management of land resources, rational use and protection of lands, regulation of land relations, maintaining land cadastre and implementation of monitoring of lands;

10) ensuring realization of transport policy, requirements satisfaction of economy and the population of the Republic of Kazakhstan in transportations, ensuring availability and quality of transport services, and also development of transport infrastructure;

11) ensuring development of the industry, mining and metallurgical complex, mechanical engineering, construction industry, subsurface use regulation, and also housing relations and municipal services;

12) ensuring requirements satisfaction of the population and industries of economy in energy and energy resources, developments of production of oil products and gas, gas supply, power industry, heat supply, use of atomic energy, development of renewable energy resources, and also uranium production;

13) ensuring cyber security, effective digital transformation of economy, development of digital infrastructure, and also personal data protection, electronic document and digital signature;

14) ensuring planning and budget implementation, tax administration, national debt management, regulation in the field of customs affairs, public procurements, and also managements of state-owned property;

15) ensuring development and carrying out monetary policy of the state, functioning of payment systems, implementation of currency control and currency exchange control;

16) ensuring stability of financial system, regulation and development of the financial market, monitoring of the financial market and financial organizations, and also protection of consumer interests of financial services;

17) ensuring realization of single state policy in the field of public service and control of respect for quality of rendering the state and socially responsible services, and also forming and enhancement of state policy in the field of statistical activities;

18) ensuring development of entrepreneurship, public-private partnership, regulation of activities of subjects of natural monopolies, protection of the competition and restriction of monopolistic activities;

19) ensuring development and regulation of foreign trade activity, domestic trade, development and promotion of export of non-oil goods and services, and also consumer protection;

20) development and implementation of measures for carrying out foreign policy and foreign economic activity of the Republic of Kazakhstan, ensuring protection of national interests on the international scene, and also protection of the rights and legitimate interests of citizens and legal entities of the Republic of Kazakhstan abroad;

21) ensuring protection of bases of the constitutional system, state sovereignty, territorial integrity, economic, scientific and technical and defense potential, protection of Frontier of the Republic of Kazakhstan, maintenance and providing with government communication, and also counteraction to terrorism and extremism;

22) ensuring defense capability of the state, combat and mobilization readiness of Armed Forces of the Republic of Kazakhstan, other troops and military forming, special state and law enforcement agencies of the Republic of Kazakhstan, the armed protection of territorial integrity and sovereignty of the country;

23) safety of protected persons and the protected objects;

24) ensuring protection of public order, fight against crime, public safety, traffic safety;

25) providing prevention and liquidation of emergency situations of natural and technogenic nature and their effects, functioning and developments of the state system of civil protection;

26) ensuring protection and recovery of rights and freedoms of man and citizen of the Republic of Kazakhstan, the rights and legitimate interests of legal entities, societies and the states, identification and elimination of violations of legality, the reasons and conditions promoting them and also their effects;

27) ensuring forming and realization of anti-corruption policy, identification, suppression, disclosure and investigation of corruption offenses;

28) ensuring counteraction of legalization (laundering) of income gained in the criminal way, to financing of terrorism and financing of distribution of weapons of mass destruction;

29) other directions according to the legislation of the Republic of Kazakhstan.

3. Distinctive signs of public service from other types of labor activity are:

1) the special legal status of government employees providing the additional rights, obligations, privileges, guarantees and restrictions established by the laws of the Republic of Kazakhstan;

2) special conditions and procedure for revenues to public service, its passings and terminations;

3) the public nature of activities of government employees including execution of the ex-officio full powers directed to realization of functions and tasks of the state, protection of interests of the state and society, and also ensuring realization of rights and freedoms of man and citizen of the Republic of Kazakhstan according to the Constitution of the Republic of Kazakhstan and the laws of the Republic of Kazakhstan.

Article 7. Basis of execution of public service

Execution of public service is based on commitment to state policy, trust of society to public service and fidelity of the government employee to the oath taken to them.

Execution of public service imposes to the government employee requirements to the Kazakhstan patriotism, professionalism, customer focus, openness, ethics and faultless reputation, and also intolerance to offenses and conflict of interest.

Article 8. Kazakhstan patriotism

Public service in the Republic of Kazakhstan is performed by citizens of the Republic of Kazakhstan on the basis of the Kazakhstan patriotism which is expressed in fair execution of the assigned job responsibilities, service to the people as to the single source of the government, ensuring protection of bases of the constitutional system and national interests of the Republic of Kazakhstan, and also in suppression of the actions causing damage to interests of public service.

Article 9. Professionalism

1. Professionalism of the government employee is determined by its formation, availability of the competences necessary for proper execution of job responsibilities, work experience - in case of its establishment by qualification requirements, and also performance excellence of job responsibilities.

2. Performance excellence of job responsibilities includes goal achievement, the established Constitution of the Republic of Kazakhstan and the laws of the Republic of Kazakhstan, performance indicators of activities of the state bodies including provided by documents of System of state planning of the Republic of Kazakhstan, timely and proper execution of job responsibilities, orders and acts of higher state bodies and officials.

3. Qualification and competences of the candidate applying for occupation of the state position are confirmed by compliance to the qualification requirements imposed for specific state position.

4. The efficiency evaluation of execution of job responsibilities is performed according to this Law and acts of the President of the Republic of Kazakhstan.

Article 10. Customer focus

1. Customer focus includes set of the requirements imposed to the organization of activities and official behavior of the government employee directed to creation of the conditions necessary for effective interaction with physical and (or) legal entities taking into account their rights, freedoms and legitimate interests.

2. The government employee shall consider addresses of physical and (or) legal entities to the terms established by the legislation of the Republic of Kazakhstan and to represent them within the ex-officio full powers complete and irrefragable answers.

3. The government employee shall take measures for the organization of the activities of state body aimed at providing realization of the rights, freedoms and legitimate interests of physical and (or) legal entities including:

1) without their address if the moment of emergence of their rights can be determined also in the presence of its consent;

2) based on one address in case of possibility of ensuring simultaneous realization of several interconnected rights of physical and (or) legal entities;

3) irrespective of the residence of physical persons or the location of legal entities if other is not provided by the laws of the Republic of Kazakhstan;

4) non-admission of refusal in consideration of the address on the formal bases by provision to the applicant of opportunity to eliminate errors, inaccuracies or discrepancies allowed in the address and the enclosed documents, and also to submit missing documents or documents with the expired effective period if their representation is provided by regulatory legal act of the Republic of Kazakhstan.

4. For the purpose of increase in efficiency of interaction with physical persons and legal entities the government employee takes measures for continual improvement of activities of state body, including:
