About modification of some regulations (about expenses on judicial examination)
The Parliament adopts this organic law.
Art. I. - In part (2) Article 227 of the Code of penal procedure of the Republic of Moldova No. 122/2003 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 248-251, 699), with subsequent changes to make the following changes:
in Item 2) of the word "and research of physical evidences;" shall be replaced with words ", research of physical evidences and other objects;";
add part with Item 22) of the following content:
"22) expenses on production of judicial examination and on other related services;".
Art. II. - In the Law on judicial examination and the status of the court expert No. 68/2016 (Official monitor of the Republic of Moldova, 2016, Art. No. 157-162, 316), with subsequent changes, to make the following changes:
1. In part (2) Article 19 of the word", applied as appropriate" to exclude.
2. State Article 75 in the following edition:
"Article 75. Fee on production judicial /
extrajudicial examination
(1) Judicial/extrajudicial examination is made on condition of advance payment by the customer of its cost. Rates for production of judicial and extrajudicial examinations, including rates for other related services, affirm the Government.
(2) Within criminal cases and cases on offenses expenses on production of judicial examination, including expenses on other related services, become covered for the account and within the approved budget of public judicial and expert organization, except as specified, provided by part (2) Article 142 of the Code of penal procedure No. 122/2003, and/or when the parties on own initiative and at own expense request examination production.
(3) Within civil cases payment of judicial examination is made previously by the party which requested examination about what it is specified in the act of purpose of judicial examination.
