About introduction of amendments to the order of the Minister of Energy of the Republic of Kazakhstan of May 29, 2020 No. 214 "About approval of rules of rendering the state services of the Department of Energy of the Republic of Kazakhstan in the field of subsurface use"

1. Bring in the order of the Minister of Energy of the Republic of Kazakhstan of May 29, 2020 No. 214 "About approval of rules of rendering the state services of the Department of Energy of the Republic of Kazakhstan in the field of subsurface use" (it is registered in the Register of state registration of regulatory legal acts at No. 20776) the following changes:

"According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" I ORDER:";
2) and 3) of Item 1 of the Order to be reworded as follows subitems:
"2) rules of rendering the state service of the Department of Energy of the Republic of Kazakhstan "The conclusion (signing) of contracts for subsurface use on hydrocarbons" according to appendix 2 to this order;
3) rules of rendering the state service of the Department of Energy of the Republic of Kazakhstan "The conclusion (signing) of supplementary agreements to contracts for subsurface use on hydrocarbons" according to appendix 3 to this order.";
in Rules of rendering the state service of the Department of Energy of the Republic of Kazakhstan "Transition of the right of subsurface use and (or) the objects connected with the subsurface use right", approved by the specified order:
be reworded as follows Item 1:
"1. These rules of rendering the state service of the Department of Energy of the Republic of Kazakhstan "Transition of the right of subsurface use and (or) the objects connected with the subsurface use right" (further – Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services and socially responsible services" (further – the Law) and determine procedure for rendering the state service of the Department of Energy of the Republic of Kazakhstan "Transition of the right of subsurface use and (or) the objects connected with the subsurface use right" (further – the state service).";
4) of Item 2 to be reworded as follows the subitem:
"4) the web portal of "the digital government" – the digital object representing "single window" of access to the consolidated information placed by the state bodies and other subjects participating in provision of the state services including the regulatory legal base and also to the state and other services rendered electronically.";
be reworded as follows Item 2-1:
"2-1. The service provider provides the direction of information on the changes and (or) amendments made by the service provider in these rules in Single contact center, and also to the operator of information and communication infrastructure of "the digital government" within three working days from the date of their enforcement.";
be reworded as follows item 4:
"4. The main requirements to rendering the state service through the web portal of "the digital government" including the characteristic of process, form, content and result of rendering, the basis for refusal in rendering the state service and also other data taking into account features of rendering the state service are stated in the List of the main requirements to rendering the state service "Transition of the Right of Subsurface Use and (or) the Objects Connected with the Subsurface Use Right" (further – the List) according to appendix 1 to these rules.
For receipt of the state service and (or) the objects connected with the subsurface use right uslugopoluchatel directs to the service provider through the web portal of "the digital government", the statement according to appendix 2 to these rules with appendix of the necessary documents specified in Item 8 of the List to transition of the right of subsurface use (share in the subsurface use right).
The statement on issue of permission to share issue and other securities which are the objects connected with the subsurface use right in the address in the organized market of securities is filled in according to appendix 3 to these rules with appendix of the necessary documents specified in Item 8 of the List.
The statement for issue of permission to share issue or other securities which are the objects connected with the subsurface use right in the address in the organized market of securities in case of placement them within additional issue (release) moves the issuer according to appendix 3 to these rules.
In cases when release into the stream of commerce in the organized market of securities is made by the holder of these shares or other securities, the application is submitted by such holder.";
be reworded as follows Item 7:
"7. Confirmation of acceptance of document package is award of number of the statement in the web portal of "the digital government" and the notification on reception of an application sent to the e-mail address of the uslugopoluchatel specified in case of filing of application.
In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays, reception of applications and issue of results of rendering the state service is performed the next working afternoon.";

List of the documents and data necessary for rendering the state service |
For receipt of the state service the uslugopoluchatel fills in the application form in the web portal of "the digital government" with appendix of electronic copies of notarially attested documents confirming the data specified in the statement: The statement on issue of permission to transition of the right of subsurface use (share in the subsurface use right) and (or) the objects connected with the right of subsurface use is filled in according to appendix 2 to these rules. The following data and documents are enclosed to the application: 1) the information about person (organization) having (having) intention to acquire the subsurface use right (share in the subsurface use right) and (or) the objects connected with the subsurface use right: for physical persons – surname, name and middle name (if it is specified in the identity document) the acquirer, the residence, nationality, data on identity documents); for legal entities – the name of the acquirer, its location, specifying on its state accessory, data on state registration as the legal entity, the information about heads and their powers, the information about persons, the organizations and states having opportunity directly or indirectly to determine the decisions made by the applicant; 2) specifying on the acquired subsurface use right (share in the subsurface use right) and (or) objects connected with the subsurface use right; 3) the basis of transition of the right of subsurface use (share in the subsurface use right) and (or) the objects connected with the subsurface use right; 4) the data on financial and technical capabilities of person having intention to acquire the subsurface use right (share in the subsurface use right), for carrying out transactions on investigation and (or) hydrocarbon production, uranium production, confirming its compliance to the requirements of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" (further – the Code) shown by provision of such right of subsurface use (are not required in case of transition of the objects connected with the subsurface use right); 5) confirmation of the applicant that all information about him specified in the statement and documents attached to it is reliable; 6) surname, name and middle name (if it is specified in the identity document) person who signed the application on behalf of the applicant, data on the document proving his identity. In case of application of provisions of article 43 of the Code about the priority right of the state in addition to the data provided in subitems 1) – 6) the statement for issue of permission shall contain in addition data on transaction price on transition of the right of subsurface use (share in the subsurface use right) and (or) the objects connected with the right of subsurface use and about procedure for its payment. The statement on issue of permission to share issue and other securities which are the objects connected with the subsurface use right in the address in the organized market of securities is filled in according to appendix 3 to these rules: 1) the full name of the organization issuer, whose shares or other securities which are the objects connected with the subsurface use right are subject to release into the stream of commerce in the organized market of securities; 2) specifying on the subsoil plot to which the related shares or other securities which are subject to release into the stream of commerce in the organized market of securities belong; 3) data on the size of the authorized capital of the organization issuer, whose shares or other securities which are the objects connected with the subsurface use right are subject to release into the stream of commerce in the organized market of securities; 4) data (type and total quantity) on securities, including derivative securities of the organization, their underlying assets or other forms of equity which are the objects connected with the subsurface use right and are subject to release into the stream of commerce in the organized market of securities; 5) the information about the underwriter (in case of its availability); 6) data on the organized market of securities on which listing will be performed; 7) data on the number of the shares or other securities which are the objects connected with the subsurface use right and the securities which are subject to release into the stream of commerce in the organized market; 8) the written confirmation of the applicant that all information about him specified in the statement and documents attached to it is reliable; 9) surname, name, middle name (in the presence), date, data on the document proving the identity of person who signed the application. The statement for issue of permission to share issue or other securities which are the objects connected with the subsurface use right in the address in the organized market of securities in case of placement them within additional issue (release) moves the issuer. In cases when release into the stream of commerce in the organized market of securities is made by the holder of these shares or other securities, the application is submitted by such holder. |
