About modification and amendments in some legal acts of the Republic of Kazakhstan concerning enhancement of safe working conditions, protection of labor rights of workers and social security
Article 1. Make changes and additions to the following legal acts of the Republic of Kazakhstan:
1. In the Labor code of the Republic of Kazakhstan of November 23, 2015:
1) in Article 16:
in the subitem 33):
the word "claims" to replace with the word "determines";
"specialized products for dietary (medical and preventive)" shall be replaced with words words "food products dietary medical and dietary preventive";
the word "establishes" to replace with the word "determines";
in the subitem 34) "specialized products for dietary (medical and preventive)" shall be replaced with words words "food products dietary medical and dietary preventive";
The subitem 6) of Item 1 of Article 22 to state 2) in the following edition:
"6) payment of idle time, overtime work, work in festive and the days off, at night according to this Code;";
3) in Article 26:
the subitem 4) of Item 1 after the words "population shifts" to add with the words "except for the foreigners and stateless persons included in the list of persons determined by the Government of the Republic of Kazakhstan who do not require receipt of permission of local executive bodies to implementation of labor activity";
add with Item 1-1 of the following content:
"1-1. The conclusion with physical person of the civil agreement is not allowed if at it there is at least one of distinctive signs of the employment contract, stipulated in Article the 27th of this Code.
The agreement containing one or several distinctive signs of the employment contract, stipulated in Article the 27th of this Code is recognized the employment contract irrespective of its actual name the parties and attracts consequence in law according to the labor law of the Republic of Kazakhstan.";
The subitem 2) of Item 1 of Article 32 to add 4) with the words "or the certificate of person who is looking for shelter";
