About introduction of amendments to some Laws of Ukraine concerning transfer in insurance years of service of the period of wrongful dismissal of the worker
The Verkhovna Rada of Ukraine decides:
I. Make changes to such laws of Ukraine:
1. "About obligatory national pension insurance" (Sheets of the Verkhovna Rada of Ukraine, 2003, No. No. 49-51, of Art. 376 with the following changes) after paragraph two to add part one of article 24 of the Law of Ukraine with the new paragraph of the following content:
"In insurance years of service the period of the induced truancy caused by wrongful dismissal, based on the judgment about recovery at work illegally of the dismissed worker who took legal effect and for which the employer paid insurance premiums in the amount of, provided by paragraph one of this part is set off".
With respect thereto third - the sixth to consider paragraphs respectively paragraphs the fourth - the seventh.
2. In the Law of Ukraine "About collection and accounting of single fee on obligatory national social insurance" (Sheets of the Verkhovna Rada of Ukraine, 2011, No. 2-3, of Art. 11 with the following changes):
Paragraph two of part two of Article 7 to state 1) in the following edition:
"The specified procedure for charge of fee extends also to persons to whom the difference in earnings during accomplishment of below-paid work is added or after dismissal from work the salary (income) for worked time, or according to the judgment - the average salary for induced truancy is added. At the same time the amount of single fee added for every month of induced truancy or taking into account difference in earnings during accomplishment of below-paid work cannot be less than the size of the minimum insurance premium";
Part the eighth articles 9 after paragraph two to add 2) with the new paragraph of the following content:
