In recent years in our country large-scale reforms on enhancement of system of execution of court resolutions and acts of other bodies are implemented.
At the same time, in case of execution of court resolutions there is need for enhancement of mechanisms of collection of overdue debt, elimination of problems by transfer to creditors of the property which is not realized at auction and also in enhancement of the legislation on execution of court resolutions and acts of other bodies aimed at providing priority of the rights of creditors.
This Law makes addition to article 56 of the Law of the Republic of Uzbekistan "About execution of court resolutions and acts of other bodies", determining that the bans imposed on property by the bodies performing state registration of the rights to real estate and other corporeal rights are cancelled based on the resolution of the state contractor; the resolution of the state contractor is the basis for state registration (registration) of the right to property behind person specified in it; the available obligations on property remain for the debtor who was it the same the owner, except as specified, when the claimant voluntarily assumes accomplishment of these obligations.
At the same time addition according to which it is determined that the ban imposed on real estate is removed according to the resolution of the state contractor accepted based on the deed of conveyance to the claimant of unrealized property is made to article 56 of the Law of the Republic of Uzbekistan "About state registration of the rights to real estate".
