About modification of the Civil code of Ukraine concerning enhancement of separate provisions regarding property rights of intellectual property
The Verkhovna Rada of Ukraine decides:
I. Bring in the Civil code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2003, Art. No. No. 40-44, 356) such changes:
1. The second Article 190 to exclude part.
2. To state part one of Article 421 in the following edition:
"1. Persons of law of intellectual property are: the creator (creators) of object of intellectual property right (the author, the contractor, the inventor, etc.) and other participants of the civil relations who possess personal non-property and (or) property rights of intellectual property according to this Code, other law or the agreement".
3. State Article 429 in the following edition:
"Article 429. Intellectual property rights on the object created in connection with accomplishment of the employment contract (contract) or passing of military service
1. Personal non-property intellectual property rights on the object created in connection with accomplishment of the employment contract (contract) or service duties during passing of military service belong to the worker (serviceman) who created this object. In the cases provided by the law, separate personal non-property intellectual property rights on such object can belong to legal entity or physical person where or for which the worker works.
2. Property rights of intellectual property on the object created in connection with accomplishment of the employment contract (contract) belong to the worker who created this object and legal entity or physical person where or for which it works, jointly, if other is not established by this Code or the agreement.
Property rights of intellectual property on the object created in connection with accomplishment of service duties during passing of military service belong to the subject determined by the law.
