About modification of some regulations (the prevention of sexual exploitation and the sexual abuses made concerning children and fight against them)

This law shifts the Directive of the European parliament and Council 2011/93/EU of December 13, 2011 about fight against sexual violence and sexual exploitation of children and child pornography and about replacement of the Framework decision of Council 2004/68/JAI, published in the Official magazine of the European Union by L 335/1 of December 17, 2011, CELEX: 32011L0093.
Art. I. - In the Criminal code of the Republic of Moldova No. 985/2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, Art. No. 72-74, 195), with subsequent changes to make the following changes:
1. In part (Articles of 21 figures "175," to exclude 2).
2. Add Article 54 with part (3) the following content:
"(3) the Child who is the victim of the crimes provided by Articles 2081, 2084 and 2085, is exempted from criminal liability for the crimes committed by him in connection with this status.".
3. In part (articles 106-1 of figure "208-2082," to replace 1) with figures "208-2085,".
4. In part (3) Article 107 of the word", 208, 2081 and 2082." shall be replaced with words "and 208-2085.".

7. Add the code with Articles 132-4 and 132-5 of the following content:
"Article 132-4. Material about sexual abuse concerning the child
As material about sexual abuse concerning the child it is understood:
a) any material which is visually representing the child involved in the explicit, real or simulated sexual actions, or any image of genitals of the child, first of all in the sexual purposes;
b) any realistic images of the child involved in explicit sexual actions, or any realistic images of genitals of the child, first of all in the sexual purposes.
