About use of condemned property in the social purposes or in public concerns
The Parliament adopts this organic law.
This law shifts part (5) Articles 18, Article 19 and part (2) Article 20 of the Directive (EU) 2024/1260 European parliament and Council of April 24, 2024 about return and the confiscation of assets published in the Official magazine of the European Union by L of May 2, 2024, CELEX: 32024L1260.
This law creates the legal base necessary for use in the social purposes or in public concerns of the confiscated properties and sums of money received as a result of criminal activities.
(1) Use in the social purposes represents process of redistribution of the confiscated properties and sums of money, including the sums of money received as a result of execution of judgments on criminal cases on confiscation in equivalent and also the sums of money repatriated or which are subject of the international agreement about the Section for the purpose of support of social and nature protection projects, financing of types of activity on economic development, and also assistance to general welfare. These types of activity include, but are not limited to them: social services, educational services, medical services or services of health care, service in the field of culture and communitarian services for benefit of communities and certain categories of persons, in particular socially marginalized groups or vulnerable persons whose main objective is the satisfaction of social requirements and improvement of quality of life. Redistribution for this purpose of the confiscated properties and sums of money can be performed for benefit of physical persons, legal entities of private law who are not pursuing revenue generating purposes such as associations, funds, private institutions, religious cults and their components or other non-governmental organizations.
