About modification and amendments in the Labor code of the Republic of Tajikistan

Article 1. Bring in the Labor code of the Republic of Tajikistan of July 23, 2016 (Akhbori of Majlisi Oli of the Republic of Tajikistan, 2016, No. 7, Art. 604; 2022, No. 7, Art. 439; 2024, Art. No. 5-6, 255) following changes and amendments:

1. State Article 7 in the following edition:

"Article 7. Prohibition of discrimination in employment relationships

1. All citizens have equal opportunities for implementation and protection of labor rights, discrimination in employment relationships, including sexual harassments and oppressions on workplace is forbidden.

2. Any distinction, discrimination, exception, restriction or preference in employment relationships on the real and (or) possible bases concerning physical persons or group of persons, their relatives or persons, related otherwise, on signs of race, skin color, origin, floor, language, religion and beliefs, national and (or) ethnic origin, disability, the state of health, suspicion or availability of disease of the acquired immunodeficiency/human immunodeficiency virus is forbidden, to age, nationality, belief, the property status, family obligations or other circumstances which are not connected with professional qualities of the worker, the purpose or consequence of which damnification, destruction and (or) understating of the recognized rights and freedoms, uses or realization of all human rights and freedoms on the basis of equality is.

3. Distinctions, exceptions, priorities and restrictions, stipulated by the legislation in employment relationships, caused by special requirements of certain work type or special care of the state of persons needing special social and legal protection (on the basis of sex, age, physical insufficiency, family obligations, the social and cultural status), is not discrimination.
