About modification of the Order of the Government of the Russian Federation of May 4, 2012 No. 442

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to the Rules of complete and (or) partial restriction of the mode of consumption of electrical energy approved by the order of the Government of the Russian Federation of May 4, 2012 No. 442 "About functioning of the retail markets of electrical energy, complete and (or) partial restriction of the mode of consumption of electrical energy" (The Russian Federation Code, 2012, No. 23, Art. 3008; 2013, No. 1, Art. 68; 2017, No. 23, Art. 3323; 2018, No. 34, Art. 5483; No. 39, Art. 5970; 2023, No. 23, Art. 4140; 2024, No. 36, Art. 5482; No. 45, Art. 6825; No. 53, Art. 8750).

2. Recognize to invalid:

the paragraph of the thirty eighth of the subitem "b" of Item of 2 changes which are made to acts of the Government of the Russian Federation, approved by the order of the Government of the Russian Federation of November 1, 2024 No. 1479 "About introduction of amendments to some acts of the Government of the Russian Federation" (The Russian Federation Code, 2024, No. 45, the Art. 6825);

the subitem "an" of item 4 of changes which are made to acts of the Government of the Russian Federation concerning remote control of technological operating modes and operational condition of power lines, the equipment and devices of the power generation facilities and the power accepting installations approved by the order of the Government of the Russian Federation of December 27, 2024 No. 1937 "About introduction of amendments to some acts of the Government of the Russian Federation concerning remote control of technological operating modes and operational condition of power lines, the equipment and devices of power generation facilities and the power accepting installations" (The Russian Federation Code, 2024, No. 53, the Art. 8750).

Changes which are made to Rules of complete and (or) partial restriction of the mode of consumption of electrical energy

1. To add the paragraph of the seventh of Item 1 with words ", during the periods when concerning such territories the prohibition on implementation of mining of digital currency established by the Government of the Russian Federation is not effective (including participation in mining-bullet)".

2. In the subitem "b" of Item 35 of the word "system operator" shall be replaced with words "the subject of supervisory control in power industry".

3. In Item 36 (1):

a) word in paragraph three "the system operator (the subject of supervisory control in technologically isolated territorial electric utility system)" shall be replaced with words "the subject of supervisory control in power industry";

b) the fourth to add the paragraph with words ", and requirements to filling of the specified forms".

4. In Item 37:

a) word in paragraph one "the system operator (the subject of supervisory control in technologically isolated territorial electric utility system)" shall be replaced with words "the subject of supervisory control in power industry";

b) after the paragraph of third to add with the paragraph of the following content:

"If it is provided by requirements of the subject of supervisory control in power industry, the network organization develops schedules of emergency restriction with separation for the periods of year (no more 2), specified in requirements of the subject of supervisory control in power industry, taking into account seasonal change of loading of consumption of power receiving devices of consumers and need of ensuring the actual sales opportunity of emergency restrictions for the amount set by the subject of supervisory control in power industry.";

c) the fourth to add the paragraph with words the maximum capacity of which makes 150 kW and more and which are attached to objects of electric grid economy at the level of voltage of 6 kV and above, except for the power receiving devices specified in paragraph six of this Item";

d) after the paragraph of the fourth to add with the paragraph of the following content:

"In schedules of restriction of the mode of consumption power receiving devices of the population and the categories of the consumers specified in appendix No. 1 to the pricing Bases in the field of regulated prices (rates) in power industry approved by the order of the Government of the Russian Federation of December 29, 2011 No. 1178 "About pricing in the field of regulated prices (rates) in power industry" equated to it are not subject to inclusion if such power receiving devices are used only for the household needs which are not connected with implementation of business or business (professional) activity.";

e) paragraphs the sixth and tenth to recognize invalid.

5. Add with Items 37 (1) - 37(3) following contents:

"37(1). In case of schedule development of restriction of the mode of consumption and introduction of changes in them according to Item 39 (1) these rules inclusion in such schedules of power receiving devices of consumers is performed with respect for the following priority (in decreasing order):

power receiving devices with which use are performed mining of digital currency (including participation in mining-pools) and (or) activities of the operator of mayningovy infrastructure in the territories specified in paragraph seven of Item 1 of these rules;

the power receiving devices attached to power network on the fourth category of reliability of electric utility service;

power receiving devices with which use are performed mining of digital currency (including participation in mining-pools) and (or) activities of the operator of mayningovy infrastructure in the territories which are not specified in paragraph seven of Item 1 of these rules and also power receiving devices of the consumers performing the following types of economic activity - rural, forestry, hunting, fishery and fish breeding, the mining processing productions, transportation and storage, construction, trade wholesale and retail, repair of vehicles and motorcycles, activities in the field of information and communication;

other power receiving devices which are not specified in paragraphs the second - the fourth this Item.

Between the consumers specified in paragraph four of this Item, priority of inclusion in schedules of restriction of the mode of consumption of the power receiving devices belonging to them by the types of economic activity specified in paragraph four of this Item is not established.

37(2). In case of schedule development of temporary shutdown of consumption and introduction of changes in them according to Item 39 (1) these rules inclusion in such schedules of power receiving devices of consumers is performed with respect for the following priority (in decreasing order):

the power receiving devices attached to power network on the fourth category of reliability of electric utility service;

power receiving devices of consumers concerning which there is technical capability of remote commissioning of such schedules from the feeding centers or from control center of networks of the network organization;

other power receiving devices of consumers which are not specified in paragraphs second and third this Item.

In the territories specified in paragraph seven of Item 1 of these rules in case of schedule development of temporary shutdown of consumption and introduction of changes in them inclusion in such schedules of power receiving devices with which use are performed mining of digital currency (including participation in mining-pools) and (or) activities of the operator of mayningovy infrastructure, is performed within groups of the power receiving devices determined taking into account the priority established by paragraphs the second - the fourth this Item, in first-priority procedure in relation to power receiving devices of other consumers of electrical energy.

37(3). In case of schedule development of emergency restriction determination by the network organization of the consumers included in such schedules, distribution between them required amounts of emergency restrictions and determination of priority of inclusion of consumers in schedules of emergency restriction are performed by the network organization with observance of the requirements provided by Items 37 - 37(2) these rules and the rules of development and application of schedules of emergency restriction of the mode of consumption of electrical energy (capacity) and use of antiemergency automatic equipment approved by the federal executive body performing functions on development of state policy in the field of fuel and energy complex.".

6. In Item 38:

a) in paragraph six "corresponding" to exclude the word;

b) to add the paragraph of the eighth with words "(further - the headquarters on electric utility service safety)";

c) the ninth to declare the paragraph invalid;

d) add with the paragraph of the following content:

"In the cases specified in Item 38 (1) these rules, the total size of emergency restrictions for the territories of appropriate subject of the Russian Federation can be increased in comparison with the sizes provided by this Item according to the solution of the headquarters on electric utility service safety.".

7. Add with Item 38 (1) the following content:

"38(1). If amounts of the emergency restrictions provided by requirements of the subject of supervisory control in power industry on schedule development of emergency restriction (including taking into account the supervisory control set by the subject in power industry of distribution of amounts of emergency restrictions on separate power nodes (energorayon) and (or) places of power network), are not enough for prevention of development and liquidation of violations of normal operating mode of the power lines and the power grid equipment which are not relating to subjects to scheduling, or possibility of replacement of power receiving devices of consumers concerning which schedules of emergency restriction, on other power receiving devices included in such schedules are enacted in case of long preserving the reasons which formed the basis for enforcement of schedules of emergency restriction the network organization has the right to initiate schedule development of emergency restriction in the amounts exceeding the amounts provided by requirements of the subject of supervisory control in power industry.

The offer of the network organization on schedule development of emergency restriction shall including contain the required size of emergency restrictions and its reasons in the amounts exceeding the amounts provided by requirements of the subject of supervisory control in power industry.

The decision on need of schedule development of emergency restriction for the amounts exceeding the amounts provided by requirements of the subject of supervisory control in power industry is accepted by the headquarters on safety of electric utility service by results of consideration of the specified offer of the network organization.

The specified decision shall contain the requirements to amounts, time and places of input of emergency restrictions determined based on requirements of the subject of supervisory control in power industry and offers of the network organization and providing:

schedule development of emergency restriction in the amounts exceeding the amounts provided by the subject of supervisory control in power industry (including on separate power nodes (energorayon) within the territory of the subject of the Russian Federation and (or) to places of power network - in amounts there are at least amounts specified in requirements of the subject of supervisory control in power industry);

realization of the amounts of emergency restrictions specified in requirements of the subject of supervisory control in power industry for time of input of emergency restrictions provided by the specified requirements.

In case of acceptance by the headquarters on safety of electric utility service of the emergency restriction specified in this decision item of graphics are developed by the network organization according to such decision.".

8. In Item 39:

a) in paragraph one "corresponding" to exclude the word;

b) word in paragraph four "the system operator (the subject of supervisory control in technologically isolated territorial electric utility system)" shall be replaced with words "the subject of supervisory control in power industry".

9. Item 39 (to state 1) in the following edition:

"39(1). In case of essential change of operating mode of the power accepting installations of the consumers included in the approved schedules of emergency restriction, decrease or increase in consumption of electrical energy and (or) capacity of power supply system, including in connection with completion of technological accession to power networks and implementation of new power receiving devices of consumers, emergence (origin threat) of deficit of electrical energy and capacity or deficit of handling capacity in controlled sections and on certain sites of power network, caused including long emergency (urgent) repair of facilities for production of electrical energy and (or) objects of electric grid economy, the decision on need of modification of the approved schedules of emergency restriction is made by the subject of supervisory control in power industry based on assessment of calculations of the electrical power mode and the analysis of threat of emergence of deficit of electrical energy and capacity, deficit of handling capacity in controlled sections and on certain sites of power network.

The decision on need of modification of the approved schedules of emergency restriction is made by the network organization in cases:

essential change of operating mode of the power accepting installations of the consumers included in the approved schedules of emergency restriction;

emergence in the consumers or consumers specified in paragraph three of this Item which power receiving devices are technologically attached to the objects of electric grid economy or power receiving devices included in schedules of emergency restriction, electroreceivers of emergency armor according to acts of approval of technological and (or) emergency armor which electric utility service is performed from the power lines included in schedules of emergency restriction in case of allocation of such electroreceivers on the separate feeding lines according to Item 37 of these rules;

completion of technological accession to power networks and implementation of new power receiving devices of consumers;

need of change of subject list of consumers and (or) the list of power receiving devices and the power lines or feeders included in schedules of emergency restriction feeding them;

need of redistribution of amounts of emergency restrictions between the consumers included in schedules of emergency restriction.

Specified in paragraphs one and the second this decision item about need of modification of the approved schedules of emergency restriction are subject to approval of the headquarters on electric utility service safety, the decisions on entering into the approved schedules of emergency restriction of the following changes which except for are not requiring such approval:

change of the name of the organization of the consumer, the name of substation, the name and (or) number of feeder (accession) included in schedules of emergency restriction;

change of method of input of shutdown according to the schedule of temporary shutdown of consumption or time of shutdown of loading of consumption;

redistribution of loading between the power receiving devices of one consumer included in the schedule of emergency restriction without scope change of emergency restrictions on such consumer.

Modification of the approved schedules of emergency restriction in the cases provided by paragraphs the first the eleventh this Item is performed by the network organization based on the requirements to amounts, time and places of input of emergency restriction determined by the subject of supervisory control in power industry.

In the cases provided by paragraph one of Item 38 (1) these rules, modification of the approved schedules of emergency restriction is performed at the initiative of the network organization based on the solution of the headquarters for electric utility service safety. The specified decision shall conform to the requirements provided by paragraphs the fourth - the sixth Item 38 (1) these rules.

The changes made to the approved schedules of emergency restriction according to this Item shall be approved by the network organization with the subject of supervisory control in power industry before approval of such changes.

The procedure and terms of approval or acceptance by the headquarters on safety of electric utility service of the decisions provided by this Item, and also procedure and terms of approval of the subject of supervisory control in power industry and approvals of the changes made to schedules of emergency restriction are determined by the rules of development and application of schedules of emergency restriction of the mode of consumption of electrical energy (capacity) and use of antiemergency automatic equipment approved by the federal executive body performing functions on development of state policy in the field of fuel and energy complex.".

10. In Item 40:

a) in paragraphs one and the second "corresponding" to exclude the word;

b) the fourth to state the paragraph in the following edition:

"In case of enforcement of schedules of emergency restriction restriction (shutdown) of giving of electrical energy on power receiving devices of consumers is performed with observance of requirements to amounts, places and time of input of the emergency restrictions specified in dispatching team (order) of the subject of supervisory control in power industry, and the priority provided by Items 37 (1) and 37(2) these rules.";

c) add with the paragraph of the following content:

"In need of replacement of power receiving devices of consumers concerning which schedules of emergency restriction, on other power receiving devices are enacted in case of long preserving the reasons which formed the basis for enforcement of schedules of emergency restriction the network organization independently determines and realizes priority of inclusion (shutdown) of accessions and replacement of power receiving devices concerning which emergency restrictions, on other power receiving devices included in schedules of emergency restriction with observance of the amounts set by dispatch center and places of input of the emergency restrictions and requirements provided by the paragraph the fourth this Item are introduced.".

11. In Item 41 of the word of "schedules of temporary shutdown of consumption" shall be replaced with words "schedules of emergency restriction".

12. In Item 44 of the word "appropriate subject" to replace with the word of "subject".

13. Item 45 in paragraph one "corresponding" to exclude the word.

14. The fourth Item 46 after words of "the subject of supervisory control" to add the paragraph with the words "in power industry".

15. In Item 48 to replace the word "subjects" with the word "subject".
