About simplification of procedures in construction and connection of objects to distribution engineering networks

For the purpose of simplification of procedure of architectural and construction activities, including in the existing building of settlements, and also procedure for construction and connection of objects to distribution engineering networks:

1. Determine that:

1.1. in case of construction or reconstruction on the parcel of land provided for construction and servicing of the single-family apartment house, the state organizations * the single-family apartment house of the fifth class of complexity (further – the single-family apartment house) and (or) non-residential capital constructions of the fifth class of complexity (further – capital constructions) in rural settlements ** based on the passport of the builder the specified passport can be constituted in the reduced structure determined by the Ministry of Architecture;

* For the purposes of this Decree the state organizations are understood as the unitary enterprises, national associations and other legal entities whose property is in property of the Republic of Belarus or its administrative and territorial unit and more than 50 percent having the right to accomplishment of building and construction works on objects of the first or fourth of classes of complexity are assigned to them on the right of economic maintaining or operational management, and also the organization from shares of the state in authorized fund.

1.2. preparation of set of documents as a part of the passport of the builder according to the statement of legal and (or) physical persons, including individual entrepreneurs (further – the applicant), is performed by the municipal unitary enterprises created for the purposes of preparation of allowing documentation or the affiliated municipal unitary enterprises created by municipal unitary enterprise on capital construction of regional executive committee and authorized by regional executive committee on preparation of allowing documentation (further – KUP), on paid basis according to request district, city (the cities of regional and district subordination) executive committee, local administration of the area in the city within implementation of the corresponding ministerial procedure.

The payment for preparation of KUP of set of documents as a part of the passport of the builder is created by creation of economic calculations (calculations) in the amount of economically reasonable costs connected with its development and profitability level no more than 10 percent. The invoice for payment of preparation of set of documents is made out KUP to the applicant within 3 calendar days from the date of receipt of request.

CLUMPS within 20 calendar days from the date of payment receipt performs preparation of set of documents as a part of the passport of the builder and transfers it in district, city (the cities of regional and district subordination) executive committee, local administration of the area in the city.

The passport of the builder in time no later than 5 working days from the date of transfer of set of documents as a part of the passport of the builder is approved by the head of the structural unit district, city (the cities of regional and district subordination) executive committee, local administration of the area in the city performing state powers of authority in the field of architectural, town-planning and construction activities and goes to the applicant;

1.3. the state organizations in case of construction of single-family apartment houses and (or) capital constructions have the right to apply the project documentation included in republican fund of the project documentation without development of the project documentation on project binding, including in case of construction of such objects based on the passport of the builder;

1.4. the state organizations within one year from the date of state registration of the parcel of land provided for construction and servicing of the single-family apartment house are granted right to sell of the single-family apartment houses and capital constructions (in the presence) including which are not completed by construction of capital structures (buildings, constructions) in case of high construction readiness * built based on the passport of the builder at auction without work for their preservation and (or) state registration.
