About the next measures for providing competitive environment and transparency in system of public procurements

For the purpose of the effective organization of execution of the established priority tasks for further enhancement of system of anti-corruption, development of competitive environment in public procurements, and also further support of participation of domestic manufacturers in this sphere I decide:

I. Purposes

1. Determine paramount task of the Ministry of Economics and finance in the sphere of public procurements forming convenient, modern and service - the oriented ecosystem of public procurements, proceeding from requirements of the state customers and widespread introduction of technologies of artificial intelligence in it.

2. Determine the main target indicators of development of the sphere of public procurements till 2030:

(a) finishing level of use of competitive methods in public procurements to 80 percent;

(b) finishing the size of the saved means on public procurements to 25 trillion sum;

(c) increase in activity of subjects of entrepreneurship in the sphere of public procurements twice;

(d) finishing share of domestic production in the procurements conducted by the state customers, at least to 85 percent;

(e) providing share of the workers of the state customers responsible for implementation of purchases who underwent advanced training, at the level at least 98 percent.

II. Increase in economy and efficiency in system of public procurements

3. Start since March 1, 2026 on special information portal of public procurements the Electronic module of calculation of the average market price of subject of public procurements on the basis of technologies of artificial intelligence (further - the module).

4. Establish procedure according to which the state customer before carrying out public procurement creates the average market price of subject of public procurements in the module. At the same time:

(a) if the difference between the starting price of subject of public procurements or at the price of the agreement and its average market price in the module exceeds 10 percent or constitutes less than 20 percent, such purchases are estimated as having high risk, subject to first-priority check, and are the basis for conducting extraordinary check by state control bodies in the sphere of public procurements;

(b) purchases under direct agreements are conducted without excess of the average market price of subject procurements in the module, except as specified, stipulated by the legislation.

5. To the Ministry of Economics and finance jointly with Audit Chamber, the Prosecutor General's Office and the Ministry of Justice in two-month time to bring procedure for determination of the average market price of subject of public procurement in the Cabinet of Ministers.

III. Development of competitive environment in the sphere of public procurements

6. Agree with the offer of the Ministry of Economics and finance, Audit Chamber and Prosecutor General's Office on implementation since January 1, 2026 in public procurements of new procedure for procurement of separate types of goods (works, services) by means of competitive method - "request for proposals".

7. Approve:

(a) The inventory (works, services) which can be purchased by the state customers by means of "request for proposals", according to appendix No. 1 *;

(b) The scheme of implementation by the state customers of purchases by means of "request for proposals", according to appendix No. 2*.

8. Determine that since January 1, 2026:

(a) the Inventory (works, services) which procurement is conducted under direct agreements is cancelled, and public procurements according to this list are conducted with use of the competitive methods, except as specified, provided by the Law "About Public Procurements";
