About gas supply

This Law according to Item 11 of part I of article 94 of the Constitution of the Azerbaijan Republic governs the relations arising between subjects of gas supply, consumers and state bodies (structures) operating in the sector of gas supply in connection with transportation, distribution, storage, realization, import, gas consumption and operation of gas installations and determines legal, economic and organizational basis of gas supply.

Chapter 1. General provisions

Article 1. Basic concepts

1.1. The basic concepts used in this Law have the following values:

1.1.1. balancing - set of the actions performed by the operator of gas-transport system on regulation of flow of gas by supply of gas in gas transmission network in the amounts corresponding to demand or selection from it of excessive amounts of gas for the purpose of maintenance of balance of gas supply system in operational limits;

1.1.2. physical connection - accession of the gas line laid for supply of gas to gas devices of the customer, to the point of connection determined by the operator of gas-distribution system;

1.1.3. the consumer - the legal entity or physical person acquiring gas according to the purchase and sale agreement and using it in fuel quality or raw materials;

1.1.4. the large consumer - the consumer whose construction object is connected to gas transmission network and (or) annual consumption of gas of which is equal or exceeds the limit set by the body (structure) determined by relevant organ of the executive authority;

1.1.5. the specialized contractor - the legal entity performing maintenance which workers received the competence certificate according to the procedure, established by this Law, or the physical person who is engaged in business activity without formation of legal entity;

1.1.6. gas - the extracted natural gas, oil (passing) gas, gas of gas-condensate fields;

1.1.7. gas installation - the device used in the course of gas consumption in fuel quality or raw materials, which is meeting the requirements of technical regulations and having the certificate of conformity;

1.1.8. the seller of gas - the wholesale seller and the retail seller;

1.1.9. gas sale - the activities connected with wholesale and retail sale of gas;

1.1.10. gas networks - gas transmission network and gas distribution network;

1.1.11. rules of gas supply system - the document regulating allowing conditions in the sector of gas supply and also technical aspects of relations between subjects of gas supply concerning planning, development, construction, installation, operation of gas supply system, the organization of systems of dispatching management and information technology management, prevention and accident elimination, connection to gas networks and balancing, and between these subjects and consumers;

1.1.12. the gas supply facility - set of the equipment, the pipelines, installations and the related structures used for transportation, distribution, storage, realization, use, consumption, and also gas import;

1.1.13. the sector of gas supply - set of types of activity on transportation, distribution, storage, realization and gas import;

1.1.14. gas supply system - set of gas networks, underground gas storages and other gas supply facilities;

1.1.15. subjects of gas supply - the legal entities performing activities for transportation, distribution, storage, realization and gas import according to the procedure, established by this Law;

1.1.16. gas transportation - gas transportation by the operator of gas-transport system on gas transmission network;

1.1.17. gas transmission network - pipeline network, used for gas transportation and being on balance of the operator of gas-transport system;

1.1.18. the operator of gas-transport system - the legal entity performing gas transportation;

1.1.19. gas distribution - delivery of gas-distribution system of gas by the operator to consumers through gas distribution network;

1.1.20. gas storage - set of services in pumping gas in underground gas storages, to storage and selection, except for the gas which is stored in quality of reserve for implementation of gas-transport system of the functions by the operator;

1.1.21. the operator of storage system of gas - the legal entity performing gas storage in underground gas storage;

1.1.22. instructions for use gas - the document approved by the body (structure) determined by relevant organ of the executive authority, and regulating the legal and organizational matters connected with retail sale of gas;

1.1.23. the operator of gas-distribution system - the legal entity performing gas distribution to consumers on gas distribution network;

1.1.24. gas distribution network - the economic complex created for gas distribution interconnected in the organizational, technology and technical relation (pipelines and lines in point of connection, security system and control and measuring systems, the gas equipment);

1.1.25. not the residential customer - other consumers, except for consumers, the stipulated in Article 1.1.30 presents of the Law;

1.1.26. connection point - the place of physical connection of the gas line of construction object to gas network;

1.1.27. commercial accounting - process of measurement of gas and collection, storage, processing and information transfer about results of measurement, and also about the gas amount received in the settlement way for the purpose of carrying out settlement between the parties according to transportation agreements, distributions, storages and gas sales;

1.1.28. rules of commercial accounting - the document determining the rights and obligations of subjects of gas supply and consumers in connection with the organization and ensuring commercial accounting;

1.1.29. household gas installation - the gas installation with gas consumption to 10 cubic meters an hour used for domestic needs;

1.1.30. the residential customer - the physical person using gas for domestic needs in apartment houses and apartments, including in specialized premises, the stipulated in Article 91 Housing code of the Azerbaijan Republic;

1.1.31. inspection - the activities performed for the purpose of determination of the working condition of the gas installations and gas lines of the consumer located on border of balance sheet accessory (further - gas installations and gas lines), chimneys, and also ventilating and airexchange lines, and condition of observance of requirements of technical safety, including identification of shortcomings and (or) violations;

1.1.32. the operating gas distribution network - network pressure to MPa 0,3 in the territories with the approved documents of territorial planning, and also located at distance of 100 meters on straight line from border (entrance) of the parcel of land on which it is located (will locate) construction object, to point of connection to gas distribution network;

1.1.33. the retail seller - the legal entity performing retail sale of gas to consumers;

1.1.34. flat fare - the monthly element of rate applied to each consumer for the purpose of covering of part of the costs of the fixed nature which are not depending on gas consumption established by the body (structure) determined by relevant organ of the executive authority;
