Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of the relations in the field of the national social insurance.

Operation of this Law does not extend to the relations connected with insurance and national health insurance and also with compulsory national social insurance from labor accidents and occupational diseases.

Article 2. Legislation on the national social insurance

The legislation on the national social insurance consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about the national social insurance then are applied rules of the international treaty.

Article 3. Basic concepts

In this Law the following basic concepts are applied:

the national social insurance - system of the state guarantees directed to prevention of loss of the income of insured persons in case of approach of insured events;

subjects of the national social insurance - the insurer, insurers and insured persons;

payments for the national social insurance - the payments in the form of benefits made by fund to insured person in case of loss occurrence;

fund - the State Social Insurance Fund of the National agency of social protection in case of the President of the Republic of Uzbekistan (further - the National agency of social protection) created at the expense of means of the republican budget of the Republic of Uzbekistan, insurance premiums and other sources, having the status of the legal entity intended for financing of payments for the national social insurance in case of loss occurrence to insured person;

the insurer - fund of the National agency of social protection;

insurance years of service - the period of implementation of payment of insurance premiums for insured person;

insured person - the physical person protected from insured events by the national social insurance;

the insurer - person paying the social tax and (or) insurance premiums for the purpose of ensuring protection of insured person in case of approach of insured events.

Article 4. Basic principles of the national social insurance

The basic principles of the national social insurance are legality, all-humanity, equality, financial stability and accountability.

Chapter 2. Legal relationship on the national social insurance

Article 5. Action of the national social insurance

Action of the national social insurance concerning citizens is performed on obligatory or voluntary basis.

The national social insurance is performed on obligatory basis in the relation:

the citizens performing labor activity on the basis of employment contracts (except for persons involved on temporary (seasonal) basis on the terms of the employment contract for accomplishment of certain work depending on specialization of Dehkan economy), and also the citizens performing activities as heads of legal entities;

the citizens performing works based on the signed contracts of civil nature with legal entities or physical persons on rendering services, performance of works or creation of intellectual property items.

The national social insurance is performed on voluntary basis in the relation:

self-employed persons;

members of Dehkan economy and other persons involved on temporary (seasonal) basis on the terms of the employment contract for accomplishment of certain work depending on specialization of Dehkan economy;

the citizens who are owners of the personal homestead parcels of land, or members of their families occupied on the personal homestead parcels of land or which are going in for livestock production (cattle, sheep, goats, horses and others), greenhouse facility, poultry farming (hens, quails, turkeys, geese, ducks), rabbit breeding, beekeeping, fish breeding, gardening, limonovodstvo, floriculture on this square (irrespective of the area of the homestead parcel of land belonging to them or quantity of the pets who are grown up by them and birds);

the citizens of the Republic of Uzbekistan working in trading houses, representations (including without formation of legal entity), the organizations created (opened) in foreign states state bodies and other organizations of the Republic of Uzbekistan;

the citizens of the Republic of Uzbekistan working abroad on hiring;

the foreign citizens and persons without citizenship who are constantly living in the territory of the Republic of Uzbekistan and performing activities, revenue-producing in the territory of the Republic of Uzbekistan;

unemployed citizens in case of payment for them of insurance premium by the spouse (spouse);

the citizens gaining income in quality of founders (participants) of legal entities;

individual entrepreneurs, including subjects of mechanical activities - members of Hunarmand association;

the family members performing activities in the form of family entrepreneurship without formation of legal entity;

heads of Dehkan economy;

the citizens gaining income from the employer to whom according to the legislation the obligation on charge and tax withholding is not assigned.

Persons insured by the national social insurance on obligatory or voluntary basis have the equal rights and obligations.

Social insurance coverage of the military personnel, faces of the commanding and ordinary structure of law-enforcement bodies, National guard of the Republic of Uzbekistan, judges and the prosecution agencies workers having class ranks (military ranks) is established by the separate legislation.

Article 6. The relations on the national social insurance

The relations on the national social insurance arise in the following cases:

a) at insurers:

for payers of the social tax - from the moment of emergence of the obligation on payment of the social tax;

for persons which are subject to compulsory national social insurance - from the moment of charge of the income;

for persons which are subject to voluntary national social insurance - from the moment of payment of insurance premiums.

At the same time, if the insurer pays pro se insurance premium, he enters the relations on the national social insurance as insured person;

b) at the insurer - from the moment of registration of insurer;

c) at insured persons:

for persons insured by compulsory national social insurance - from the moment of charge of the income;

for persons insured by voluntary national social insurance - from the moment of payment of insurance premiums.

Article 7. Insured events

Approach of obligation of the insurer on implementation to insured person of payments for the national social insurance is considered insured event.
