Article 311 of the Arbitral Procedure Code of the Russian Federation (Russian Federation Code, 2002, No. 30, Art. 3012; 2010, No. 52, Art. 6994; 2014, No. 26, Art. 3392; 2018, No. 32, Art. 5133; 2022, No. 1, Art. 42; No. 24, the Art. 3943) to add with part 2.1 following of content:

"2.1. The circumstances specified in Items 2 and 3 of part 2 of this Article can be established in addition to sentence by the resolution on refusal in initiation of legal proceedings, the determination or the resolution on the termination of criminal case or criminal prosecution which are taken out:

1) in connection with lapse of time;

2) in connection with elimination of crime and punishability of act by the new penal statute;

3) in connection with compensation of damage;

4) in connection with purpose of measure of criminal and legal nature in the form of judicial penalty;

5) in connection with application of enforcement powers of educational impact;

6) in connection with application of enforcement powers of medical nature;

7) in connection with the death of the person accused;

8) in connection with not achievement of age by person from which there comes criminal liability, or lagging of the minor in the mental development which is not connected with mental disturbance;

9) in connection with active repentance;

10) in connection with conciliation of the parties;

11) in connection with release from criminal liability based on part one of article 78.1 of the Criminal Code of the Russian Federation;

12) in connection with application of the act of amnesty.".
