Article 1

Bring in the Federal constitutional Law of October 4, 2022 No. 5-FKZ "About acceptance to the Russian Federation of the Donetsk People's Republic and education as a part of the Russian Federation of the new subject - the Donetsk People's Republic" (The Russian Federation Code, 2022, No. 41, Art. 6930; 2023, No. 18, Art. 3212; 2024, No. 53, Art. 8484; Official Internet portal of legal information (www.pravo.gov.ru), 2025, on November 28, No. 0001202511280097) following changes:

1) in Article 6:

a) regarding 1 word "during the transition period" shall be replaced with words "till January 1, 2028";

b) in part 5 of the word "During the Transition Period" shall be replaced with words "Till January 1, 2028";

3) in Article 12:

5) part 1 of Article 21 to add with Item 3 following of content:

"3) implementation of powers on federal state land control (supervision) (except for federal state land control (supervision) concerning lands of agricultural purpose which turnover is regulated by the Federal Law of July 24, 2002 No. 101-FZ "About land turnover of agricultural purpose", vinogradoprigodny lands, federal state land control (supervision) exercised by the federal executive body performing functions on control and supervision in the field of environmental management, and also except for federal state land control (supervision) exercised by federal executive bodies in the field of safety, in the field of the state protection), participations of officials of the public company, created according to the Federal Law of December 30, 2021 No. 448-FZ "About the public company "Roskadastr", in holding control (supervising) actions and uses of the information on damnification (damage) or on threat of damnification (damage) to the values protected by the law provided by them when implementing such supervision (except for features which are established according to part 10 of Article 22 presents of the Federal constitutional Law) in coordination with the federal executive body authorized on implementation of normative legal regulation in the respective sphere.";

"Article 21.1. Features of emergence of the right of the state-owned or municipal property to separate objects of property and the order such objects in the territory of the Donetsk People's Republic

1. The apartment houses, apartments, rooms (further - premises) having signs of ownerless property are recognized property of the Donetsk People's Republic or property of its municipalities. Signs of ownerless property concerning premises, procedure for identification and accounting of such premises, property type (property of the Donetsk People's Republic or property of its municipalities) in which the premises having signs of ownerless property arrive are established by the law of the Donetsk People's Republic in coordination with the federal executive body performing functions on maintaining the Single state real estate register, the state cadastral registration of real estate, state registration of the rights to real estate and the federal executive body performing functions on management of state-owned property.

2. The property right of the Donetsk People's Republic or the property right of its municipalities to the premises having signs of ownerless property arises by law from the date of inclusion of such premises in the register of property of the subject of the Russian Federation or in the register of municipal property, but no later than January 1, 2030 and is subject to state registration according to the Federal Law.

3. Lack of information about the owner of premises or availability of documents which of content it is not possible to establish the owner of premises is not obstacle for state registration of the property right of the Donetsk People's Republic or the property right of its municipalities to such premises in the Single state real estate register.

4. The premises which had signs of ownerless property and arrived according to this Article in property of the Donetsk People's Republic or in property of its municipalities:

1) it are provided to citizens of the Russian Federation whose residence is in the territory of the Donetsk People's Republic and which premises are lost or acknowledged unsuitable for accommodation as a result of fighting (diversions, acts of terrorism), acts of aggression against the Russian Federation, according to the procedure, established by the law of the Donetsk People's Republic in coordination with the federal executive body authorized on implementation of normative legal regulation in the respective sphere taking into account the following features in property:

a) citizens of the Russian Federation have in property of other premises, suitable for accommodation, or share in the right of common property to other premises, suitable for accommodation, in the territory of the Donetsk People's Republic no at least accounting regulation of the total area of premises established by the specified law of the Donetsk People's Republic;

b) citizens of the Russian Federation did not get or refused receipt of measures of support on acquisition, construction or capital repairs of premises which were lost or acknowledged unsuitable for accommodation as a result of fighting (diversions, acts of terrorism), acts of aggression against the Russian Federation in connection with which citizens of the Russian Federation address for provision of premises;

2) are provided in ownership and in use for accommodation according to the employment contract of specialized premises to citizens of the Russian Federation according to the Housing code of the Russian Federation. At the same time till January 1, 2028 provision by public authorities of the Donetsk People's Republic and local government bodies of its municipalities of office premises of the state and municipal housing stocks respectively from among the premises specified in paragraph one of this part is allowed (irrespective of the level of the public power):

a) to persons replacing the state positions, municipal positions, the government employee (persons replacing positions of the public civil service, military service, public service of other types), including the employees replacing position of the district police officer, to the local government officers, workers replacing in bodies of the public power of position, not carried to positions of the public or municipal service;

b) to employees of the companies and organizations subordinated to bodies of the public power, including employees of the educational organizations and medical organizations;

3) are transferred to the federal possession according to the procedure, provided for differentiation of property according to the features specified in Item 1 of part 5 of Article of 21 presents of the Federal constitutional Law provided that such premises are free from the third party rights, except as specified provisions of office premises to persons replacing the state positions of the Russian Federation, to the federal government civil servants, the military personnel, persons replacing positions of the Federal State Service of other types;

4) it are provided to the citizens of the Russian Federation who lost the property right to premises which had signs of ownerless property and arrived in property of the Donetsk People's Republic or in property of its municipalities, on conditions and according to the procedure which are specified in part 5 of this Article in property;

5) are provided in ownership and in use for accommodation under the agreement of social hiring to citizens of the Russian Federation whose residence is in the territory of the Donetsk People's Republic and who stay on the registry as persons in need in premises according to the Housing code of the Russian Federation. Features of transfer to citizens of such premises to property (privatizations) can be established by the law of the Donetsk People's Republic in coordination with the federal executive bodies specified regarding 1 this Article.
