About modification of some orders of the Government (supplementing some veterinary health requirements and microbiological criteria for foodstuff and establishing special rules of official control of availability of trichinellas in meat)

Based on part (8) article 17 of the Law No. 82/2024 on official control in the agrofood sphere (The official monitor of the Republic of Moldova, 2024, Art. No. 199-201, 265), with subsequent changes, DECIDES: the Government

This resolution:

- shifts the Implementation regulations of the Commission (EU) 2024/2463 of September 12, 2024 establishing analytical methods of official control for check of compliance of operators of food industry to Regulations (EU) No. 2073/2005, CELEX: 32024R2463, published in the Official magazine of the European Union by L 2024/2463 of September 13, 2024;

- partially shifts Implementation regulations (EU) 2015/1375 of the Commission of August 10, 2015 establishing special rules of official control of availability of trichinellas in meat, CELEX:32015R 1375, shifts Article 2-6, 8-10, 12-13, of Appendix I and IV () published in the Official magazine of the European Union by L 212 of August 11, 2015, with the last changes made by Implementation regulations (EU) 2025/506 of the Commission of March 19, 2025.

1. In the Requirements concerning microbiological criteria for foodstuff, approved by the Order of the Government No. 221/2009 (Official monitor of the Republic of Moldova, 2009, Art. No. 59-61, 272), with subsequent changes, to make the following changes:

1.1. to add formula of harmonization with the text "and Executive regulations (EU) 2024/2463 of the Commission of the September 12, 2024 establishing the analytical methods applied to the official control which is carried out for confirmation of conformity of operators of the food sector to Regulations (EU) No. 2073/2005, CELEX: 32024R2463, European Union published in the Official magazine L 2024/2463 of September 13, 2024";

1.2. add with Items 10-1, 10-2 and 10-3 of the following content:

"10-1. In the analysis of the tests which are selected during the official control which is carried out for check of observance of the rules and criteria established in these Requirements, the official laboratories appointed by competent authority according to article 35 of the Law No. 82/2024 on official control in the agrofood sphere (further - the Law No. 82/2024), the reference analytical methods specified in appendix shall use.

10-2. In departure from Item 10-1 the appointed official laboratories can use alternative analytical methods, including the patented methods provided that these alternative analytical methods of validirovana according to the reference analytical methods specified in appendix according to the protocol established in the SM EN ISO 16140-2:2017, standard and validirovana or for the category of foodstuff specified in the corresponding microbiological criterion established in appendix or for wide range of foodstuff as it is specified in the SM EN ISO 16140-2:2017 standard. The appointed official laboratories can also use alternative analytical methods if these alternative analytical methods of validirovana according to other scientific protocols recognized at the international level.

10-3. If the alternative methods mentioned in Item 10-2, are the patented methods, they shall be certified by independent certification body. Certification shall include summary or the reference to results of validation of the patented method and the statement for quality management of the production process applied to this method. The result of certification shall specify that quality of ensuring production process of the producer was estimated and at least once in five years is subject of repeated assessment by means of procedures of prolongation.".

2. In the Order of the Government No. 1086/2017 about approval of the Veterinary and sanitary regulations on establishment of the specific regulations applied to official checks of meat on availability of trichinellas (The official monitor of the Republic of Moldova, 2017, Art. No. 441-450, 1218) to make the following changes:

2.1. in the resolution:

2.1.1. state the name in the following edition:

"About approval of the Regulations on establishment of the special rules applied concerning official control of availability of trichinellas in meat";

2.1.2. in Item 1 "Veterinary and sanitary regulations on establishment of the specific regulations applied to official checks of meat on availability of trichinellas" to replace the text with the text "Regulations on establishment of the special rules applied concerning official control of availability of trichinellas in meat";

2.2. in appendix No. 1 to the resolution:

2.2.1. in all text of appendix the text "Veterinary and sanitary regulations on establishment of the specific regulations applied to official checks of meat on availability of trichinellas" in any grammatical form to replace with the text "Regulations on establishment of the special rules applied concerning official control of availability of trichinellas in meat" in the corresponding grammatical form, and the words "entrepreneur of the food sector" in any grammatical form - the words "operator of the agrofood sphere" in the corresponding grammatical form;

2.2.2. to state formula of harmonization in the following edition:
