ORDER OF THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

About modification of some orders of the Government (quality requirements of the processed and preserved foods)

Based on part (4) article 1 of the Law No. 279/2017 on informing consumers concerning foodstuff (The official monitor of the Republic of Moldova, 2018, Art. No. 7-17, 54), with subsequent changes, and parts (16) article 3 of the Law No. 296/2017 on general requirements of hygiene of foodstuff (The official monitor of the Republic of Moldova, 2018, Art. No. 7-17, 60), with subsequent changes, DECIDES: the Government

This resolution partially shifts the CODEX STAN 66-1981 Standard for table olives (it is accepted in 1981, it is reviewed in 1987, 2013 and it is changed in 2022, 2023).

1. In the Order of the Government No. 68/2009 about approval of the Technical regulation "Flour, Semolina and Bran from Grain of Cereals" (Official monitor of the Republic of Moldova, 2009, Art. No. 23-26, 107), with subsequent changes, to make the following changes:

1.1. in the name and on all content "Technical regulation" flour, semolina and bran from grain of cereals"" in any grammatical form to replace the text with the text of "The quality requirement of flour, semolina and bran from grain of cereals" in the corresponding grammatical form, and the words "this Technical regulation" in any grammatical form shall be replaced with words "these Requirements" in the corresponding grammatical form;

1.2. in the resolution:

1.2.1. to state formula of acceptance in the following edition:

"Based on Item a) parts (16) article 3 of the Law No. 296/2017 on general requirements of hygiene of foodstuff (The official monitor of the Republic of Moldova, 2018, Art. No. 7-17, 60), with subsequent changes, and parts (4) article 1 of the Law No. 279/2017 on informing consumers concerning foodstuff (The official monitor of the Republic of Moldova, 2018, Art. No. 7-17, 54), with subsequent changes, DECIDES: the Government";

1.2.2. declare Item 2 invalid;

1.2.3. in Item 3 of the word "and Ministry of Health" to exclude;

1.3. in Requirements:

1.3.1. in Item 1 the text "Technical regulation" flour, semolina and bran from grain of cereals" (further – the Technical regulation) establishes the main requirements" to replace with the text "Quality requirements of flour, semolina and bran from grain of cereals (further – Requirements) establish the special regulations applied";

1.3.2. state item 4 in the following edition:

"4. Groups of goods of the following goods items fall under action of these Requirements: 1101 00, 1102 and 1103, according to the Combined commodity nomenclature approved by the Law No. 172/2014.";

1.3.3. declare Item 5 invalid;

1.3.4. to state the name of Chapter III in the following edition:

"III. SPECIAL REQUIREMENTS";

1.3.5. state Items 8-10 in the following edition:

"8. Safety of the foodstuff and materials contacting to foodstuff is provided by means of control of safety of the foodstuff and materials contacting to foodstuff which is exercised by operators of the food sector on all food chain, including by means of use of the principles of risk analysis and critical control points (HACCP – Hazard Analysis and Critical Control Points)".

9. The operator of the food sector keeps the records allowing to control traceability of raw materials, batches and types of products and also has the documents confirming observance of quality requirements. These records are stored according to part (3) article 131 of the Law No. 306/2018 on safety of foodstuff.

10. The origin, quality and safety of the raw materials used for production of grain products are confirmed by the quality certificate issued by the producer according to article 131 of the Law No. 306/2018 on safety of foodstuff.

The raw materials used for production of grain products shall conform to requirements of the Technical regulation "Wheat, Barley, Oats, Rye, Corn and Ambercane Food" approved by the Order of the Government No. 202/2009.";

1.3.6. in Item 12 "according to the regulations established by the central industry body of public management in the field of health protection" to replace the text with the text "in the limits set by the Ministry of Health";

1.3.7. state Item 15 in the following edition:

"15. Content of pollutants in grain products shall not exceed the maximum levels established in appendix No. 1 to the Sanitary regulations about the maximum levels of certain pollutants in foodstuff approved by the Order of the Government No. 724/2024.";

1.3.8. add with Items 15-1-15-3 of the following content:

"15-1. Remaining balance of pesticides in grain products shall correspond to the maximum levels established by Sanitary regulations about the maximum levels of remaining balance of pesticides in or on foodstuff and sterns for animals of plant and animal origin, approved by the Order of the Government No. 867/2023.

15-2. Microbiological criteria of grain products shall correspond to the criteria stated in annex to the Requirements concerning microbiological criteria for foodstuff, approved by the Order of the Government No. 221/2009.

15-3. Content of radionuclides in grain products shall not exceed concentration, the most admissible from the point of view of hygiene, established in appendix F to the Main regulations of radiation safety. Hygienic requirements and rules (ONRB-2000), the Ministries of Health No. 06.5.3.3.4 approved by the resolution of February 27, 2001.";

1.3.9. state Item 17 in the following edition:
