About modification of some decisions of the Cabinet of Ministers of the Kyrgyz Republic in the field of licensed and allowing activities

For the purpose of implementation of article 5 of the Law of the Kyrgyz Republic "About modification of some legal acts of the Kyrgyz Republic in the field of licensed authorization system", according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Bring in the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About questions of licensing of separate types of activity" of December 14, 2023 No. 678 the following changes:

- to declare the subitem 4 of Item 1 invalid;

in Regulations on the licensing of separate types of activity approved by the above-stated resolution:

- state Item 7 in the following edition:

"7. The license, appendix to the license and (or) permission are issued in the paper or electronic form created by means of the automated information system of the licensor.";

- state Item 13 in the following edition:

"13. The result of implementation by the licensor of functions on licensing is drawn up by the act of the licensor in paper and (or) electronic form. The act of the made decision is placed in personal account of the applicant in the automated information system of the licensor in day of decision making and is subject to storage in licensed case in paper and (or) electronic type.";

- add Item 15 with the paragraph of the following content:

"The licensor has the right to grant the license and (or) permission of earlier specified term.";

- to state the name of Chapter 9 in the following edition:

"Chapter 9. Documents acceptance for licensing, appendices to the license and (or) permissions and forming of licensed case";

- Item 40 after the word "licenses" to add with words ", appendices to the license";

- in Item 47:

the subitem 4 after the word "licenses" to add with words ", appendices to the license";

the subitem 6 after the word "licenses" to add with words ", appendices to the license";

- add with Item 49-1 of the following content:

"49-1. Consideration of the applications and decision making about issue (about refusal in issue) licenses and (or) permissions are performed by the licensor without formation of any collegiate organs, commissions or working groups, except for Chapters 31, of 38, 63-68, 75, 78-82, 85 of this provision.";

- state Item 56 in the following edition:

"56. In the license and (or) permission it is specified:

1) the name of the licensing body;

2) the complete and reduced (in the presence) name, form of business of the legal entity, and also legal address;

3) surname, name, middle name of physical person, data of the document proving his identity for individual entrepreneurs - registration number of record about state registration of the individual entrepreneur;

4) for the license - the licensed type of activity, for permission - action type on which permission is issued;

5) effective period of the license and (or) permission (if it is established);

6) the activities implementation territory (if it is limited territorially);

7) date of issue and registration license number and (or) permissions;

8) identification taxpayer number.

In case of need in the license and (or) permission the list of the performed works, the rendered services constituting licensed activity is specified (in the presence of the works and (or) services constituting licensed activity).";

- add with Chapter 15-1 of the following content:

"Chapter 15-1. Issue of appendix to the license

90-1. Appendix to the license is issued to the licensee for:

1) instructions of the additional work types, services, actions and transactions which are carried out within the licensed type of activity, except for Chapters 31, of 36, of 40, of 43, of 44, 51-59 this provision;

2) reflections of the address of new object of implementation of activities (for all license types).

90-2. For receipt of appendix to the license when opening new (additional) object of implementation of activities the licensee represents to the licensor:

1) the written notice of registration of appendix to the license which shall include:

- the full and abbreviated name and form of business of the legal entity - for the legal entity;

- surname, name and middle name - for physical person;

- actual address of new object of implementation of activities;

2) copy of the current license;

3) the documents provided in the Special part of this provision, connected with opening of new object which were not submitted to the licensing body earlier.

90-3. For receipt of appendix to the license in case of registration of additional work types, services, actions and transactions of the licensed type of activity the licensee represents to the licensor:

1) the written notice of registration of appendix to the license which shall include:

- the list of additional work types, services, actions and transactions which the licensee intends to perform within the licensed type of activity;

- the full and abbreviated name and form of business of the legal entity - for the legal entity;

- surname, name and middle name - for physical person;

- activities implementation address;

2) copy of the current license;

3) the documents provided in the Special part of this provision on accomplishment of additional work types, services, actions and transactions which were not provided to the licensing body earlier.

90-4. The notification shall be submitted no later than 30 calendar days prior to implementation of additional types of activity or opening of new object.

90-5. The bases for refusal in issue of appendix to the license are:

1) identification in the submitted documents of the doubtful, distorted or incomplete information;

2) discrepancy of documents of the applicant to requirements, the established Law of the Kyrgyz Republic "About licensed authorization system in the Kyrgyz Republic" and this Provision;
