About change of the resolution of the Ministry of Justice of the Republic of Belarus of April 7, 2017 No. 67
Based on subitem 7.109 of Item 7 and part one of Item 12 of the Regulations on the Ministry of Justice of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 26, 2024 No. 545, the Ministry of Justice of the Republic of Belarus DECIDES:
1. Bring in the resolution of the Ministry of Justice of the Republic of Belarus of April 7, 2017 No. 67 "About approval of the Instruction on enforcement proceeding" the following changes:
1.1. state preamble in the following edition:
"Based on subitem 7.109 of Item 7 and part one of Item 12 of the Regulations on the Ministry of Justice of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 26, 2024 No. 545, the Ministry of Justice of the Republic of Belarus DECIDES:";
1.2. in the Instruction on enforcement proceeding approved by this resolution:
in Item 218 of the word "and vehicles" shall be replaced with words "including the real estate which is common joint property of spouses and also shares in the property right to real estate (if real estate is in common ownership), and the vehicles, except as specified, provided by part one of article 933 KOBS";
in Item 222:
in the paragraph the second the words "auxiliary boarding schools, special general education boarding schools" shall be replaced with words "special boarding schools, special educational facilities";
the fourth to state the paragraph in the following edition:
"children's social boarding houses in which there are the debtor citizen's children;";
add Item 223 with part of the following content:
"The arrest on the premises, share in the right of common property to premises belonging to the debtor imposed according to part four of article 112 of the Law of the Republic of Belarus "About enforcement proceeding" is removed the legal executive in the presence:
