1. Approve the Procedure on simplification of formalities in case of airborne transportations it (is applied).

2. To the agency of civil aviation under the Government of the Republic of Tajikistan together with the relevant ministries and departments to take adequate measures on accomplishment of this Procedure.

Procedure on simplification of formalities in case of airborne transportations

1. General provisions

1. Procedure on simplification of formalities in case of airborne transportations (further - the Procedure) determine procedure by simplification of formalities in case of airborne transportations.

2. This Procedure are based on article 22 of the Convention and regulates special rules and procedures for the purpose of simplification and acceleration of airborne transportations between the territory and the territory of other states for prevention of unreasonable delay of aircrafts, crews, passengers and loads with observance of the national legal system in the field of immigration, customs, health care, phytosanitary and veterinary regulations.

3. In this Procedure it is used the following basic concepts:

1) airline - the legal entity having the air operator certificate of civil aircrafts;

2) the automated system of border control (further - ASPK) - the automated system which confirms authenticity of the electronic machine-readable travel document or identification counter determines that this passenger is legal owner of the document or identification counter, requests data from system of border control and establishes the right to crossing of border according to in advance determined rules;

3) the onboard equipment - objects, including means of first aid, crash equipment and dining facilities, held for use onboard the aircraft during flight, but not spare parts or bortpripasa;

4) bortpripasa (accessory) - bortpripasa (accessory) which are taken out and bortpripasa (accessory) spent;

5) bortpripasa (accessory) taken out - goods, held for sale to passengers and crew members for the purpose of their carrying out from aircraft board;

6) bortpripasa (accessory) spent - the sold or not sold goods intended for consumption by passengers and crew onboard the aircraft and the goods necessary for operation and maintenance of the aircraft, including fuel and lubricants;

Such goods shall be imported for specific purpose and are subject to the return export within the established period of time in steady-state condition, except changes owing to the natural wear caused by their use;

9) unloading - removal of loads, mails, baggage and bortpripas from aircraft board after its landing;

10) expulsion of person - the actions of authorities of the state made according to its laws and rules with the purpose to specify to person to leave this state;

11) release of goods - the actions of customs authorities providing transfer of the goods undergoing customs clearance to the order of the corresponding persons;

12) disembarkation (from the aircraft) - escape of the aircraft after its landing all persons, except for the crew members and passengers following the same direct flight;

13) the state of registration - the state in which register the aircraft is entered;

18) documentation concerning the state of health - the documentary evidence required by the Ministry of Health and Social Protection of the Republic of Tajikistan including documentation standardized according to the International medical and sanitary rules (further - MMSP) (2005) the World Health Organization (further - WHO) to confirm that passengers and crew members fulfilled requirements for prevention and control of spread of infectious diseases for the purposes of transit through the state or arrivals in it;

19) documents of operators of aircrafts - held for use operators of aircrafts the airfreight delivery notes/delivery notes, passenger tickets and boarding passes, documents issued according to the bank plan of mutual calculations and the plan of mutual calculations of the agent, the receipt for payment of above-standard baggage, the receipt of different charges, acts of damages and defects, luggage and cargo labels, schedules, weight and centering documents;

27) the inspector of civil aviation – person designated by authorized body in the field of civil aviation, and also it is entrusted to them to check accomplishment of air-transport transactions in the part concerning safety of flights, aviation safety or other aspects connected with these transactions, as directed the relevant authority;

28) interactive API (iAPI) - electronic system through which during registration the elements of the data API collected by the operator of the aircraft are transmitted to state bodies which within time of registration of the passenger on front desk send to this operator the response message on each passenger and/or the crew member;

29) quarantine - restriction of activities and/or department from other persons, suspicious on infection, who are not sick, or suspicious on infection of baggage, containers, transport vehicles or goods so that to prevent possible spread of infection or contamination;

30) the commander of the aircraft - the pilot responsible for control of the aircraft and its safety during flight time;

31) control of drugs - the measures taken for control of illicit movement of drugs and psychotropic substances by air;

32) person without proper documents - person who makes or tries to make trip:

- with the overdue travel document or the invalid visa;

- with false, counterfeit or changed by the travel document or the visa;

- with the travel document or the visa of other person; or

- without travel document or the visa if it is required;

33) person issuing itself for other person - person issuing himself for the legal owner of the authentic travel document;

34) person without the right to entrance - person to whom by the relevant authorities it is refused or will be refused the right to entry into the state;

35) the international airport - the airport determined by the state in the territory for acceptance and sending the aircrafts which are carrying out the international airborne transportations in which are performed customs, boundary, sanitary, quarantine (in transit animals and plants) and other control procedures;

36) actions for direct transit - the special events approved by the relevant state authorities as a result of which the aircrafts (and their loading) making short-term stop when following transit through the territory of the Republic of Tajikistan can be under direct supervision of these bodies;

37) the land equipment - the special devices used for maintenance, repair and servicing of aircrafts on the earth including the test equipment and the equipment for load handling and servicing of passengers;

38) the beginning of trip - Item in which person began the trip, apart from the airport at which it made stop in case of direct transit, following either direct, or connection flight if it did not leave zone of direct transit of this airport;

39) unclaimed baggage - the baggage which arrived to the airport and was not received or demanded by the passenger;

58) direct flight - type of flight of the aircraft when all flight from the point of departure to destination through any intermediate points is specified the operator the same symbol;

59) the mode of single window - the means allowing the parties participating in trading and transport activities to provide the standardized information and documents in one Item of entrance/import to fulfill all normative requirements connected with import, export and transit. 61) flights for assistance - the flights performed in the humanitarian purposes which transport personnel and supplies for assistance such as food, clothes, dwellings, medicines and other objects, in time or after emergency situation and/or disaster and/or which are used for evacuation of persons from places where their life or health is exposed to danger as a result of such emergency situation and/or disaster, to safe places in the same state or in other state ready to accept such persons;
