About rules and standards of safety for passenger carriers

The parliament adopts this organic law.

This law partially shifts (Article 1-9, 12, of 13, 15 and appendix III) the Directive 2009/45/EU of the European parliament and Council of May 6, 2009 about rules and standards of safety for passenger carriers, CELEX: 332009L0045, published in the Official magazine of the European Union by L 163 of June 25, 2009, with the last changes made by the Delegated regulations of the Commission (EU) 2022/1180 of January 11, 2022.

Chapter I. General provisions

Article 1. Subject of the law

Subject of this law is establishment of the regulatory base for ensuring single level of safety of life of the people and property which are onboard passenger carriers and high-speed passenger floating crafts during making of domestic flights by them, and also establishment of procedure for negotiating at the international level for the purpose of harmonization of the rules applicable to the passenger carriers and floating crafts making international flights.

Article 2. Scope of application

(1) This law is applied to the following passenger carriers and floating crafts, irrespective of their flag, making domestic flights:

a) to the new or existing passenger carriers 24 meters long and more;

b) to high-speed passenger floating crafts.

(2) This law is not applied:

1) to passenger carriers which are:

a) the public vessels or courts intended for movement of troops;

b) sailing ships;

c) the courts set in motion not by mechanical means;

d) the courts constructed of other materials except steel or equivalent material and which are not regulated by the standards applicable to high-speed floating crafts or to courts with the dynamic principle of maintenance;

e) wooden vessels of primitive design;

f) traditional courts;

g) pleasure yachts;

h) the courts floating only in port zones;

i) ocean service crafts or service crafts;

2) to high-speed passenger floating crafts which are:

a) the military floating crafts or floating crafts intended for movement of troops;

b) walking floating crafts;

c) the floating crafts floating only in port zones;

d) sea office floating crafts.

Article 3. Basic concepts

For the purpose of this law the following basic concepts mean:

1) administration of flag state – competent authorities of the state which colors the vessel or floating craft has the right to hoist. For the purpose of this law administration of flag state of the Republic of Moldova are the central authority and the Agency of water transport of the Republic of Moldova;

2) sea office floating craft – the floating craft used for comfortable transportation of the factory personnel which is not performing the works necessary for its activities onboard the appropriate floating craft;

3) high-speed passenger floating craft – ferry craft more than 12 passengers, according to the definition given in the rule X/1 of the Convention SOLAS, except for the passenger carriers making domestic flights in sea areas of category B, C and D provided that:

a) the displacement amount corresponding to project waterline does not exceed 500 cubic meters; and

b) maximum speed of movement, according to the definition given in the rule 1.4.30 Codes of HSC of 1994 and the rule 1.4.38 Codes of HSC of 2000 does not exceed 20 sea nodes;

4) the central authority – the industry central body in the field of water transport provided by the Merchant Marine Code of the Republic of Moldova approved by the Law No. 599/1999;
