About free movement and stay in the territory of the Republic of Moldova citizens of the European Union and members of their families
The parliament adopts this organic law.
This law:
- partially shifts (Article 1-3, of part (1) and (2) Articles 4, of part (1) and (2) articles 5, of article 6-9, part (1) and Items a), b), d) - f) parts (2) articles 10, of article 11-13, of part (1) and (2) Articles 14, part (1) Articles 15, Article 16, of part (1) and (4) Articles 17, Article 18, part (2) Articles 19, part (1) articles 24, of article 27-30, of part (1), (3) and (4) articles 31, of article 32-36) the Directive of the European parliament and Council 2004/38/EC of April 29, 2004 about the right of citizens of the Union and members of their families freely to move and live in the territory of state members, about change of Regulations (EEC) No. 1612/68 and about cancellation of Directives 64/221/EES, 68/360/EES, 72/194/EES, 73/148/EES, 75/34/EES, 75/35/EES, 90/364/EES, 90/365/EES and 93/96/EES (the text concerning EEP), published in the Official magazine of the European Union by L 158 of April 30, 2004, CELEX: 32004L0038, with the subsequent changes made by Regulations (EU) of the European parliament and Council No. 492/2011 of April 5, 2011;
- shifts the Directive of the European parliament and Council 2014/54/EC of April 16, 2014 about measures for simplification of implementation of the rights granted to workers in the context of free movement of workers (the text concerning EEP), published in the Official magazine of the European Union by L 128 of April 30, 2014, CELEX: 32014L0054;
- partially shifts the Directive of Council No. 77/486/EES of July 25, 1977 about education of children of workers-migrants published in the Official magazine of the European Union by L 199 of August 6, 1977, CELEX: 31977L0486;
- the Regulations (EU) shift No. 492/2011 of the European parliament and Council of April 5, 2011 about free movement of workers within the Union (the text concerning EEP) published in the Official magazine of the European Union by L 141 of May 27, 2011, CELEX: 32011R0492, with the subsequent changes made by Regulations (EU) 2019/1149 European parliament and Council of June 20, 2019.
This law establishes the main regulatory base for implementation by citizens of the European Union, citizens of the states which signed the Schengen agreement and members of their families of right to liberty of movement, the right to stay and the rights to the equal relation in the territory of the Republic of Moldova, and also the regulatory base for application concerning them rationing arrangements on the bases connected with homeland security, public order and public health.
The purpose of this law is regulation of conditions of entrance, stay and departure, the rights and obligations of citizens of the European Union and members of their families performing right to liberty of movement and the right to stay in the territory of the Republic of Moldova and also establishment of rationing arrangements on the bases connected with homeland security, public order and public health.
Operation of this law does not extend to the following categories of persons:
a) the members of diplomatic representations and consular establishments accredited in the Republic of Moldova, members of the international organizations, and also members of their families which status is regulated by international treaties which party is the Republic of Moldova or it is established by the regulatory base in other procedure;
b) citizens of the Republic of Moldova;
c) the citizens of the Republic of Moldova having nationality of the member state of the European Union or state which signed the Schengen agreement and also members of their families are natives of the third states;
d) persons behind whom the status of stateless persons in the Republic of Moldova was acknowledged;
e) foreigners whose regime is regulated by the Law on shelter in the Republic of Moldova No. 270/2008;
f) persons from structure of the foreign armed forces accompanying them civil forming and staff of foreign special anti-terrorist forming and also the representatives of foreign and international specialized agencies performing joint actions in the territory of the country based on international treaties which party is the Republic of Moldova;
g) members invited by Parliament, the President of the Republic of Moldova or the Government of official delegations or persons accompanying them.
For the purposes of this law the following basic concepts are used:
1) the citizen of the European Union - the foreigner having nationality of one of member states of the European Union or one of the states which signed the Schengen agreement, and not having nationality of the Republic of Moldova;
2) the family member - any person belonging to one of the following categories:
a) spouse or spouse of the citizen of the European Union;
b) the child who did not reach 18-year age or being dependent on the citizen of the European Union and also the spouse/spouse's children;
c) the parents who are dependent on the citizen of the European Union and also the spouse/spouse's parents;
d) members of expanded family - the faces tied by related bonds, which are not entering the family kernel consisting of parents and children including the grandfathers and grandmas, brothers, sisters, uncles and aunts which are dependent on the citizen of the European Union and also other persons hired under the contract for social support of vulnerable members of the family of the citizen of the European Union;
3) the resident card - the identity document and legal status of its owner confirming legality of stay of the citizen of the European Union and members of his family in the territory of the Republic of Moldova according to provisions of this law;
4) the right to stay - the right of the citizen of the European Union and members of his family to determine the residence or the place of temporary stay in the territory of the Republic of Moldova according to provisions of this law;
5) the decision on provision or prolongation of the right to stay - the administrative act published by the General inspectorate on migration according to this law, granting the right to stay for the term of more than 90 calendar days to members of the family of the citizen of the European Union or the right to permanent stay to the citizen of the European Union and members of his family in the territory of the Republic of Moldova;
6) legal and continuous stay - legal and continuous stay in the territory of the Republic of Moldova within at least five years before filing of application about provision of the right to the permanent stay confirmed with consecutive possession of the resident card;
7) the worker of the European Union - the citizen of the European Union performing hired or independent labor activity in the territory of the Republic of Moldova according to the legislation in the field;
8) excessive load of system of the social help - situation when the citizen of the European Union or members of his family receive social payments for more than nine calendar months during the 12-month period for lack of insurance years of service for the last 24 calendar months and as a result of unreasonable refusal of performance of work, except for:
a) receivers of social payments based on the right acquired at the expense of fees;
b) persons who are looking after children under three years;
c) persons who are studying full-time in one of educational institutions of the Republic of Moldova;
d) persons receiving pension on restriction of opportunities;
e) the minors which are dependent on one of parents - the owner of the resident card and/or the right to stay.
(1) Organa of the public power and public organizations shall cooperate for the purpose of realization of provisions of this law by ensuring the data exchange from the information systems which are available for them performed by means of platform of interoperability (MConnect). In case of data with particular legal regime provisions of special regulations are applied.
(2) the Ministry of Internal Affairs by means of organizations subordinated to it provides accounting, registration and removal from accounting at the place of residence and/or temporary stay of citizens of the European Union and members of their families, provision and prolongation of the right to stay and issue of the resident card, and also implementation of other powers established by the legislation of the Republic of Moldova.
