Bring in the Criminal code of the Kyrgyz Republic (the newspaper of "Erkin-limited liability partnership" of November 16, 2021 No. 122-133) the following change:
state Article 97 in the following edition:
"Article 97. Release from criminal liability of the child who is in the conflict with the law in connection with application to it of measures for removal from system of criminal trial
1. The child who for the first time committed crime of small weight and less serious crime, who admitted guilt in crime execution, not having criminal record and earlier not participating in the program of removal of the child from system of criminal trial is subject to release from criminal liability during pre-judicial production using measures for removal of the child from system of criminal trial according to the procedure, determined by the Code of penal procedure of the Kyrgyz Republic.
2. In case of intentional failure to carry out by the child of agreement obligations about removal of the child from system of criminal trial the prosecutor has the right to change the applied measures, to extend the duration of the agreement or to cancel the decision on removal of the child from system of criminal trial.".
Bring in the Code of penal procedure of the Kyrgyz Republic (the newspaper of "Erkin-limited liability partnership" of November 16, 2021 No. 122-133) the following changes:
1) in Item 38 of Article 5 the word "defendant" to exclude;
2) in Article 27:
a) state part 2 in the following edition:
"2. Criminal case concerning the child cannot be brought, and the brought criminal case is subject to the termination in cases, stipulated in Article the 467th of this Code.";
