About establishment of technique of determination of own means (capital) of the microcredit company

1. Own means (capital) of the microcredit company are determined as difference between assets of the microcredit company and obligations of the microcredit company.

For the purpose of determination of own means (capital) of the microcredit company assets and liabilities of the microcredit company are calculated based on account balances of financial accounting, the established Provision of the Bank of Russia of August 1, 2022 No. 803-P "About the Chart of accounts of financial accounting for not credit financial credit institutions, bureau of credit histories, credit rating agencies and procedure for its application" <1> (further - the Provision of the Bank of Russia No. 803-P), for date of determination of own means (capital) of the microcredit company.

2. In case of determination of own means (capital) of the microcredit company all assets of the microcredit company as the amount of debit balances (remaining balance) on the accounts of financial accounting of the first procedure intended according to the Provision of the Bank of Russia No. 803-P for accounting of assets of the microcredit company for date of determination of own means (capital) of the microcredit company are considered.

3. In case of determination of own means (capital) of the microcredit company are not considered:

subordinated loans (microloans), subordinated bonded loans and subordinated deposits;

the assets received from the third parties at the expense of the money and (or) property provided by the microcredit company to such third parties;

ordinary shares (shares) of credit institutions and not credit financial credit institutions;

rights to claim under the acquired agreements of the credit (loan (microloan), including acquisition value the microcredit company of rights to claim under agreements of the credit (loan (microloan), and also percent, other payments for benefit of the microcredit company and penalty (penalties, penalty fee) in the amount awarded by court or recognized by the debtor under the acquired agreements of the credit (loan (microloan), added from the moment of acquisition of rights to claim by the microcredit company under agreements of the credit (loan (microloan).

5. This Instruction is subject to official publication and according to the solution of the Board of directors of the Bank of Russia (the minutes of the Board of directors of the Bank of Russia of August 29, 2025 No. PSD-24) become effective since October 1, 2026.

6. From the date of entry into force of this Instruction to declare invalid the Instruction of the Bank of Russia of June 1, 2020 No. 5472-U "About establishment of technique of determination of own means (capital) of the microcredit company and form of calculation of own means (capital) of the microcredit company" <2>.
