About safety of food products in the Kyrgyz Republic

This Law establishes legal and organizational basis of safety of food products in the territory of the Kyrgyz Republic.

Chapter 1. General provisions

Article 1. Terms and determinations

In this Law the following terms and determinations are used:

1) safety of food products - the condition of food products testimonial of lack of the unacceptable risk connected with harmful effects per capita and future generations;

2) the state audit of safety management systems of foodstuff - form of the state control (supervision) exercised for the purpose of determination of compliance of activities of the subject to the conditions (standards, systems) declared to them and to undertaken obligations regarding observance of safety management systems of foodstuff;

3) the state control (supervision) of observance of requirements of technical regulations - activities of authorized bodies for check of observance of requirements of technical regulations to products by the legal entities and physical persons registered as individual entrepreneurs;

4) the state monitoring - the form of the state control (supervision) providing collection, the analysis and assessment of information on safety of foodstuff, food staples, forages, feed additives, cases of animals of the diseases which are transmitted to the person and also identification cases in foodstuff and sterns of remaining balance of veterinary medicines, pesticides and pollutants;

5) informing on risks - exchange of information about risks and measures for management of them between all concerned parties;

6) integrated approach in the field of safety of food products - the complex use of different methods, standards and technologies directed to risk minimization at all production phases, storages, transportations and realization of food products;

7) the Code of health of land animals - the international standards of health of land animals, and also veterinary ensuring health of the population which are updated and published by World Health Organization of animals;

8) The commission "the Code Alimentarius" - the international body according to standards on foodstuff created jointly by the Food and Agriculture Organization of the United Nations (FAO) and the World Health Organization (WHO) for the purpose of protection of health of consumers and ensuring fair practice in trade in food;

9) proper hygienic practice - creation of the conditions which are excluding possibility of accumulating in the received products of hazardous substances of chemical origin, and also not allowing mechanical and microbiological pollution which can affect safety of food products and food staples or their suitability for use at the subsequent stages of food chain;

10) proper agricultural practice - creation of conditions for production of agricultural products (food staples) at stage of primary production, and also during the transporting and storage providing production of safe food products;

11) not processed food products of animal origin - not undergone conversion (processing) of ink (carcass) of productive animal all types, their parts (including blood and offal), raw milk, raw skim milk, crude cream, products of beekeeping, egg and yaytseprodukta, catch of water biological resources, aquaculture products;

12) primary production - the production stage (production) including cultivation of plants (including using pesticides), cultivation of animals on slaughter, milking (including using veterinary medicines, forages and feed additives), and also receipt of wild plants and animals, cultivation of fish;
