About change of the laws concerning provision of loans

Article 1. Bring in the Civil code of the Republic of Belarus of December 7, 1998 the following changes:
1. To add Item 1 of article 50 after part seven with part of the following content:
"Use in the name of the legal entity, not being the microfinancial organization or other legal entity who according to legal acts has the right to perform microfinancial activities, words "loan", "microloan", "microfinancing", "money on credit" or derivative of these words is not allowed.".
2. To add Item 1 of article 317 after part two with part of the following content:
"Cannot be pledge subject of the agreement of pledge signed in ensuring obligation fulfillment of the borrower according to the loan agreement between physical persons, except for individual entrepreneurs, and also in ensuring agreement obligations of the guarantee, concluded for providing obligations of the borrower according to such loan agreement:
the single apartment house belonging on the property right to the pledger with economic constructions or without those;
the single apartment belonging on the property right to the pledger with economic constructions or without those;
share in the right of common property to the single apartment house with economic constructions or without those, belonging to the pledger;
share in the right of common property to the single apartment with economic constructions or without those, belonging to the pledger.".
3. State Article 760 in the following edition:
"Article 760. Loan agreement
1. According to the loan agreement one party (creditor) transfers to the possession to other party (borrower) the money or other things determined by patrimonial signs, and the borrower shall return to the creditor the same amount of money (loan amount) or equal quantity of other things of the same sort and quality received by it.
