About the state defense order

The purpose of this Law is regulation of the relations in the field of the state defense order.
This Law extends to the relations connected with forming, approval, approval and execution of the state defense order in the Republic of Uzbekistan, connected with ensuring defense capability, safety and protection of public order, providing the state secret, safety of persons protected by the state, the prevention and liquidation of emergency situations, maintenance of emergency rule, except for orders for products of dual purpose necessary for ensuring state security and persons protected by the state.
The legislation on the state defense order consists of this Law and other acts of the legislation.
If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about the state defense order then are applied rules of the international treaty.
In this Law the following basic concepts are applied:
the order - the official data on products of military and dual purpose necessary for ensuring needs of the customers of the state defense order connected with accomplishment of the tasks assigned to them;
the state defense order - the state order on purchase of products of military and dual purpose approved by State commission on arms of Armed Forces of the Republic of Uzbekistan;
customers of the state defense order (further - customers) - the Ministry of Defence, the Ministry of Internal Affairs, the Ministry of Emergency Situations, National guard, Service of state security, Public service of safety of the President of the Republic of Uzbekistan and other ministries and departments which are part of Armed Forces of the Republic of Uzbekistan and also the Prosecutor General's Office of the Republic of Uzbekistan, Customs committee under the Ministry of Economics and finance of the Republic of Uzbekistan conducting procurement of products of military and dual purpose within the state defense order;
the contractor of the state defense order (further - the contractor) - physical person or legal entity - resident of the Republic of Uzbekistan, the delivery agreement of products of military and dual purpose and the having right which concluded in the procedure established by the legislation within the state defense order to perform the corresponding type of activity in this sphere;
products of dual purpose - separate types of raw materials, materials, tools, the equipment, the equipment, technologies, scientific and technical information and others which can be used during creation of arms and military equipment or are applied in the military purposes, and also works (service) which can be carried out (to appear) in the civil and military purposes;
the companies of defense industry - the domestic enterprises and the organizations of defense appointment performing development, production, repair, upgrade, utilization and conversion of products of military and dual purpose;
the single agent - the authorized body determined by the President of the Republic of Uzbekistan for purchase (import) of products of military and dual purpose made abroad within the state defense order;
State commission on arms of Armed Forces of the Republic of Uzbekistan (further - State commission) - the advisory advisory body approving the state defense order which activities are created according to the procedure, determined by the President of the Republic of Uzbekistan;
Coordination council of Armed Forces of the Republic of Uzbekistan (further - Coordination council) - the body performing approval of the state defense order which activities are created according to the procedure, determined by the President of the Republic of Uzbekistan;
Organizational administrative group on realization of tasks of arms of Armed Forces of the Republic of Uzbekistan (further - Organizational administrative group) - the body performing the state defense order which activities are created according to the procedure, determined by the President of the Republic of Uzbekistan;
military products - arms, ammunition, remedies, the military and special equipment, spare parts, component parts, belongings to them which are not used in other industries and also the special materials, the special equipment and intellectual property items necessary for their production, profile documentation, the works and services which are carried out and rendered in the military purposes.
The main objectives of the state defense order are:
forming, approval and execution of the state defense order proceeding from national interests of the country, military-political situation in the world and the region, the level of threats of homeland security in the military sphere, nature of the modern military conflicts;
the timely and guaranteed arms and providing customers with products of military and dual purpose;
ensuring target and effective use of the financial resources allocated for the state defense order.
Cabinet of Ministers of the Republic of Uzbekistan:
provides realization of single state policy in the field of the state defense order;
approves procedure for forming, approval and execution of the state defense order;
determines the list of products of military and dual purpose;
determines procedure for development of the specification on purchase of products of military and dual purpose;
The Cabinet of Ministers of the Republic of Uzbekistan can perform also other powers according to the legislation.
Authorized state body in the field of the state defense order is the Agency of defense industry under the Ministry of Defence of the Republic of Uzbekistan (further - authorized state body).
Authorized state body:
creates the draft of the state defense order;
coordinates activities of state bodies and organizations, executive bodies on places, the companies of defense industry for forming and execution of the state defense order;
keeps the list of the companies of defense industry and places it in official open sources;
coordinates interaction of customers with the companies of defense industry;
provides to customers information on the companies of defense industry;
performs monitoring and progress analysis of the state defense order;
