About modification and amendments in the order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of June 1, 2022 No. 308 "About approval of Rules of provision of the measures of the state stimulation of the industry directed to performance improvement of work of subjects of industrial and innovative activities"

I ORDER:

1. Bring in the order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of June 1, 2022 No. 308 "About approval of Rules of provision of the measures of the state stimulation of the industry directed to performance improvement of work of subjects of industrial and innovative activities" (it is registered in the Register of state registration of regulatory legal acts for No. 28320) the following changes and amendments:

in Rules of provision of the measures of the state stimulation of the industry directed to performance improvement of work of the subjects of industrial and innovative activities approved by the specified order:

state Item 3 in the following edition:

"3. Cannot use measures of the state stimulation:

1) subjects of big business, except for cost recoveries in process of the state stimulation "increase in employee competence";

2) subjects of industrial and innovative activities, fifty and more percent of shares (share in the authorized capital) which directly or indirectly belong to the state, national managing holding, national holding, the national company (except for social business corporation, and also the entrepreneurs founded within the agreement on public-private partnership);

3) the applicants who violated the terms of agreement about cost recovery and which did not perform return of the money issued in process of the state stimulation in the form of cost recovery;

4) participants of the special economic zones (SEZ).";

"8) processing equipment – the equipment intended for accomplishment of the basic engineering procedures and directly involved for accomplishment of the main production function of production of products (except for logistic, refrigeration equipment, cranes, vehicles, lift trucks);";

15) of Item 5 to state the subitem in the following edition:

"15) subjects of industrial and innovative activities – physical and (or) legal entities, the particular partnerships realizing the industrial and innovative projects or performing activities for promotion of goods, works and services of the Kazakhstan origin of processing industry on internal and (or) the foreign markets;";

19) and 20) of Item 5 to exclude subitems;

state Item 12 in the following edition:

"12. The state stimulation to subjects of industrial and innovative activities directed to work performance improvement, within these rules consists in provision of the following measures of the state stimulation:

1) increase in employee competence on:

professional training and/or retraining and/or advanced training of engineering personnel, production personnel, including top managers, in the territory of the Republic of Kazakhstan and abroad, concerning work performance improvement. The head of the legal entity or the member of executive body or the head of the structural unit on production and/or promotion made products/services, except for financial (accounts department), administrative, legal division treat top managers;

duration in case of professional training and/or retraining and/or advanced training of engineering personnel, production personnel, including top managers constitutes no more than 3 (three) months;

2) implementation of digital technologies on:

acquisition of the digital equipment (3D - the scanner, the 3D-printer, the plotter - the large-format printer with functions of the scanner and copying which was not in operation of the equipment);

3) enhancement of engineering procedures on:

optimization of general functioning of the company, including the costs connected with:

carrying out energy audit;

acquisition of the processing equipment (which was not in operation of the equipment);

providing, maintenance and process management of production, including the costs connected with:

installation of equipment and/or chief installation of equipment, including instructing (training) in work with the equipment;

4) increase in efficiency of production organization is performed by implementation of progressive managerial and production technologies (energy efficient and green technologies, elements of economical production – Kaizen, TPM, Six Sigma, 5S and Kanban).";

5) of Item 13 to state the subitem in the following edition:

"5) provided annual increase in tax assignments the previous 3 (three) years prior to date of application. The requirement of this subitem does not extend to subjects of industrial and innovative activities who are tax-exempt according to the current legislation and/or about registration dates which there went less than seven calendar years before receipt date of the request to national institute.

If applicant is the individual entrepreneur, the statement from personal account on all taxes paid by the taxpayer for the last 3 (three) years, before date of application is attached to the request;";

add Item 13 with the subitem 6) of the following content:

"6) being in the register of the Kazakhstan producers.";

"14. To the subject of industrial and innovative activities the proved and documentary confirmed costs, in the amount of 40% of the amount of the incured (complete) costs not earlier than twenty four months before date of application, except for purchase costs of processing equipment and acquisition of the digital equipment are compensated:

on increase in employee competence the compensation amount shall not exceed thirty million tenges in calendar year;

on implementation of digital technologies the compensation amount shall not exceed sixty million tenges in calendar year;

on enhancement of engineering procedures the compensation amount shall not exceed sixty million tenges in calendar year, except for costs for installation of equipment and/or supervision of erection of the equipment, including instructing (training) in work with the equipment (on which the compensation amount shall not exceed twelve million tenges in calendar year);

on increase in efficiency of production organization the compensation amount shall not exceed twenty million tenges in calendar year.

On each measure of the state stimulation or cost type of measure of the state stimulation no more than one agreement on cost recovery in calendar year are signed.";

add with Item 14-1 to state the following content:

"14-1. Within purchase costs of processing equipment and acquisition of the digital equipment, to the subject of industrial and innovative activities the proved and documentary confirmed costs in the amount of 40% of total amount of the incured costs are compensated, at the same time the last payment if payment was performed by several payment documents shall be performed not earlier than twenty four months before receipt date of the request in national institute, at the same time the compensation amount shall not exceed sixty million tenges in calendar year.";

15, 15-1, 15-2 and 15-3 to exclude Items;

state Item 17 in the following edition:

"17. The cost amount of the applicant accepted to compensation by national institute is determined on the basis:

1) payment documents;

2) source accounting documents confirming reception-transmission of the equipment (the act of acceptance transfer, delivery note on inventory issue on the party and others), for the total amount of the acquired equipment, or the act (acts) for the total amount of the rendered services (the performed works).";
