About introduction of amendments to some laws of Ukraine concerning intellectual property rights on the objects created in connection with passing of military service

The Verkhovna Rada of Ukraine decides:

I. Make changes to such laws of Ukraine:

1. "About protection of the rights to industrial designs" (Sheets of the Verkhovna Rada of Ukraine, 1994, No. 7, of Art. 34 with the following changes) to add the law of Ukraine with Article 8-1 of the following content:

"Article 8-1. The right to the industrial design created during passing of military service

1. Property rights of intellectual property on the unregistered industrial design and the right to registration of the industrial design created in connection with accomplishment of service duties during passing of military service belong to the state on behalf of the body determined by part two of article 43-2 of the Law of Ukraine "About conscription and military service" if other is not provided by the law.

The industrial design is considered created in connection with accomplishment of service duties during passing of military service if it is created by the serviceman:

in connection with accomplishment of the service duties determined according to charters of the Armed Forces of Ukraine and other laws of Ukraine;

with use of office information, the experience got during passing of military service, arms, the military and special equipment or other military property.

2. The author of the industrial design created in connection with accomplishment of service duties during passing of military service reports about the created industrial design according to the procedure determined by the Charter of internal service of the Armed Forces of Ukraine.
