About additional measures for further enhancement of mechanisms of eradication of corruption factors in land relations

For the purpose of adjustment of system of effective use of the parcels of land, increase in effectiveness of measures for the prevention of plunder of lands, especially lands of agricultural purpose, and also corruption factors in the field of land relations, I decide reducings human factor in case of control in this industry:

I. Purposes

1. Determine main objectives of adoption of this resolution:

(a) adjustment of system of effective use of the parcels of land, the prevention of plunder of lands, especially lands of agricultural purpose, acceleration of processes of digitalization in the field of way of widespread introduction of information technologies to these processes;

(b) implementation by broad use of digital technologies of single system of control and further strengthening of interaction of competent authorities in the direction of the prevention of unauthorized capture of the parcels of land, constructions on such lands of illegal constructions;

(c) enhancement of mechanisms of effective use of lands, preventions of their unauthorized capture.

II. New procedures

2. Take into consideration that:

(a) the state land control is exercised by Inspectorate for control of agro-industrial complex under the Cabinet of Ministers (further - Uzagroinspektion), the Agency according to the inventory under the Ministry of Economics and finance (further - the Agency according to the inventory), the Ministry of ecology, environmental protection and climate change (further - the Ministry of ecology), the Ministry of Construction and Housing and Communal Services (further - the Ministry of construction), Inspectorate for control in the field of construction and housing and communal services (further - special representatives state bodies);

(b) The agency according to the inventory, the Supreme Court, the Prosecutor General's Office, the Ministry of Internal Affairs, Uzagroinspektion, the Ministry of ecology, the Ministry of construction, Inspectorate for control in the field of construction and housing and communal services, Bureau of forced execution, their territorial subdivisions and relevant organs of executive power at the local level bear responsibility for timely introduction of data on offenses in the field of land relations and placement of data on results of hearing of cases on such offenses in the Automated information system "E-YER NAZORAT" (further - the E-YER NAZORAT system).

3. Determine that:

(a) the E-YER NAZORAT system of the Agency according to the inventory is single electronic platform of conducting the state land control;

(b) since January 1, 2026 tasks and functions of special representatives of state bodies on early identification and acceptance of adequate measures on the facts of non-compliance with the legislation on the earth, in particular inappropriate and inefficient use of the parcels of land, unauthorized occupation of lands, and also unauthorized construction of buildings and constructions, are performed only by means of the E-YER NAZORAT system;

(c) data on the cases of high probability of violation of the law on the earth revealed by processing and the analysis of space pictures go to the E-YER NAZORAT system by means of the Interdepartmental integration platform of the Digital Government system.

At the same time the Uzbekkosmos Agency within the approved projects of implementation of the state space monitoring two times a year conducts work on identification of the facts of inappropriate and inefficient use of the parcels of land, unauthorized occupation of lands, constructions on such lands of illegal constructions by means of space monitoring at the expense of means of the Government budget;

(d) additional space monitoring can be performed by extrabudgetary funds of the interested ministries and departments;

(e) necessary data for implementation of space monitoring are represented to the Uzbekkosmos Agency by the relevant ministries and departments in accordance with the established procedure on a grant basis.

4. Agree with the offer of Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent, and also the Agency on the inventory on separation of the territories depending on the level of the offenses connected with inappropriate and inefficient use of the parcels of land, unauthorized occupation of lands, unauthorized construction of buildings and constructions on:

(a) the territories of "red" category - the territory with high probability of inappropriate and inefficient use of the parcels of land, unauthorized occupation of lands, unauthorized construction of buildings and constructions:

(b) the territories of "yellow" category - the territory with average probability of inappropriate and inefficient use of the parcels of land, unauthorized occupation of lands, unauthorized construction of buildings and constructions;

(c) the territories of "green" category - the territory with low probability of inappropriate and inefficient use of the parcels of land, unauthorized occupation of lands, unauthorized construction of buildings and constructions.

To the agency according to the inventory jointly with special representatives state bodies in three-months time to introduce to the Cabinet of Ministers the draft of the order of the Government about criteria of separation of the territories into "red", "yellow" and "green" categories and about the measures realized in them.

At the same time to provide conducting monitoring observations in the territories referred to "red" category - at least once in every quarter with use of the special drones referred to "yellow" category - at least once in each six months with use of the special airplane, and also mobilization of the main forces and means of special representatives of state bodies before elimination of the elicited facts of violation of the law.

5. Primary data about cases with high probability of inappropriate and inefficient use of the parcels of land, unauthorized occupation of lands, unauthorized construction of the buildings and constructions revealed as a result of implementation of space monitoring by the Uzbekkosmos Agency go by means of the E-YER NAZORAT system in address procedure:

(a) on category of lands of agricultural purpose - in Uzagroinspektion;

(b) on the lands occupied with the protected natural territories, the lands used in priority procedure in the ecological, scientific, cultural, esthetic, recreational and sanitary and improving purposes to the woods, zones organized within the national project "Yashil Macon" to the natural bodies of water, lands intended for special storages where are buried and dangerous wastes, and also polygons of waste - in the Ministry of ecology are stored;

(c) on the facts of construction, reconstruction and capital repair of buildings, constructions or other objects in zones where prohibitions (restrictions) for carrying out such works are established, or designings, reconstruction, constructions of buildings and constructions in defiance of the approved master plans, site plannings and buildings of the settlements (which are not provided by master plans) - in the Ministry of construction;
