About physical culture and sport
The Parliament adopts this organic law.
(1) This law regulates the organization and functioning of national system of physical culture and sport in the Republic of Moldova.
(2) Physical culture and sport the following types of activity include: physical training, school and university sport, mass sport, elite sport, professional sport, adaptive sport, physical exercises in the improving, preventive or therapeutic purposes.
(3) Organa of public management, educational institutions, and also sports structures shall encourage development of mass sport, elite sport and adaptive sport, paying special attention to creation of conditions for occupation these types.
For the purpose of this law the following concepts mean:
1) the trainer - the person having qualification in separate sport, having the corresponding professional knowledge and skills on the organization and carrying out the selection process and sports orientation, on the organization and carrying out training and training process in certain sports discipline on planning and management of training process for the purpose of achievement of sports results according to age and level of training of the athlete;
2) sports calendar - the sequence of annually organized sporting events developed by national and international federations on sports by means of which are established quantity, date and the place of their carrying out;
3) the Sports center of training of national teams - the public out-of-school educational institution responsible for training of the national teams of teams in Olympic/Paralympic sports under the direction of pedagogical personnel;
4) sports club - public association or public organization which purpose is multilateral and harmonious development of the personality by means of systematic sports activities, and for persons with special sports capabilities - enhancement of sports skill;
5) professional sports club - non-profit organization which advances professional sport and can treat separate national sports federation or professional league;
6) sports competition - the sporting event organized according to the rules established by sports structure, and recognized by the international sports organization or for circumstances by other competent sports organization;
7) specific criteria - the principles on the basis of which classification of competent sports federations is constituted and the financing priority sequence is established;
8) category of sport - set of the sports constituting single system of preparation and competitions, having similar motive structure, technical elements and acceptances, type of efforts, conditions and procedure for regulation and so on;
9) dope - use of the substances prohibited in sport representing violation of the anti-doping rules provided by the Law on prevention of dope in sport and fight No. 24/2023 against it;
10) team - created according to specific criteria (level of physical, technical and tactical training, level of the game concept, age, sex and so on) group of athletes who train and speak together at competitions for achievement of certain result;
11) sports construction / sports base - construction or the equipment/complex of constructions and the equipment which is intended/intended for occupations by physical culture and sport in one or in several sports;
12) physical culture - component of the general education which by means of the physical exercises which are carried out orderly and independently promotes changes of behavior of the person in motive, cognitive, social, esthetic and creative plans;
13) fair play - loyal adoption of rules of the game, including fair behavior in any situation, respect for rivals, decisions of judges, the audience and general spirit of game, worthy acceptance both defeats, and victories;
14) national sports federation - the association of the national level founded by merging of sports schools, sports clubs and sports associations, aimed according to the charter at development of separate sport and implementation of socially useful activities;
15) lifelong benefit - the amount which is monthly paid to person during all his life for exclusive results in sports activities;
16) sports arbitral facility - the organization considering and resolving disputes in the field of sport at national and international level;
17) the sports license / certificate of the athlete - the official document issued by national sports federations, granting to the athlete the right to participate in official competitions and at the same time assuming certain rights and obligations from the athlete and federation issuer;
18) professional league - the non-commercial association founded by professional sports clubs for the purpose of development of professional sports;
19) manipulation sports competitions - the actions encouraging, influencing or instructing the participant of sporting event to take actions which can make adverse effect on the relevant activity, for the purpose of obtaining for themselves or other person of the properties which are not due to it, services, privileges or benefits in any form;
20) the organizer of competitions - the sports organization or person irrespective of form of business, organizing sports competitions;
21) sport - set of the sports physical exercises and/or sports disciplines checked by time which are carried out in the conditions of competition by predefined rules and in certain conditions;
22) sports rate - bet in the form of cash rate counting on the cash prize caused by future and uncertain event connected with sports competition;
23) support personnel of athletes - the trainer, the instructor, the manager, the agent, team of personnel, the official of team, the guide of athletes with limited opportunities, medical or paramedical personnel which help or treat the athletes participating in sports competitions or preparing for them and also other faces working with athletes;
24) sports discipline - the complex physical exercise which is component of the sport having the structure, carried out in specific conditions of competition, estimated under certain code and the allowing differentiated and specialized participation of the athlete;
25) the Olympic sports discipline - the sports discipline entering the program of the Olympic Games;
26) Paralympic sports discipline - the sports discipline for persons with limited opportunities entering the program of the Paralympic Games;
27) Deaflympic sports discipline - the sports discipline practiced in the circle of persons with hearing disorder and entering the program of Deaflympics;
28) acknowledged discipline - the sports discipline which is not entering the official program of the Olympic Games or Paralympic Games, but recognized by the International Olympic Committee or other international organization which is under the auspices of the International Olympic Committee;
29) unrecognized discipline - the sports discipline which is not recognized by the International Olympic Committee or other international organization which is under the auspices of the International Olympic Committee;
30) outstanding punishment - punishment on which the period of disqualification or discharge of the athlete or support personnel of the athlete did not expire;
31) the Information system of management of data in the field of sport - system of digital accounting of registration and monitoring of sports structures;
32) sport - the integral part of physical culture, means and method of physical training based on use of competitive activities, and also on preparation for it for the purpose of check/use of physical, functional and technical and tactical capacities of the person or team;
33) "special olympics" - variety of the Olympic sports disciplines for the children and adults with special educational needs giving them permanent opportunities for development of the physical shape, for manifestation of courage, skills and friendship with the families and other athletes of "special olympics";
34) adaptive sport - kind of sport in which motive structures, special rules, material and organizational conditions changed and conforming to requirements of different types of violations are used;
35) elite sport - the specific activities performed within competitive system, directed to achievement of the highest results;
36) mass sport - form of sports activities which main objective is maintenance of health, education, rest, communication with the environment, solidarity and socialization;
37) the high-class athlete - person, systematically and orderly playing sports, participating in sports competitions to the purpose of exceeding of already reached by him or record results;
38) the professional athlete - the person who is engaged in certain sports discipline on the basis of professional training, having the employment contract with sports structure and earning reward for these activities;
39) technicians - set of persons to whom specific obligations on sports and/or technical and tactical preparation are assigned, being hired employees, employees or working at voluntary basis according to individual employment contracts, agreements on cooperation or special agreements;
40) sports structures - the public organizations, private institutions and public associations created for the purpose of the organization, management and implementation of sports activities and which purpose is promotion of one or several types / one or several sports disciplines practiced by their members and also participation in sports actions / competitions;
41) sports school - the public organization of out-of-school education promoting multilateral and harmonious education and training of children, teenagers and youth, including persons with special educational needs;
42) the veteran of sport - the person who promoted in sport as the high-class athlete, the trainer and/or sports manager and made outstanding contribution to development and promotion of elite sport at the national or international levels.
(The State advances 1) and stimulates development of physical culture, sport and the Olympic Movement. Occupations physical culture and sport are the right of each person guaranteed by the state without any discrimination.
(2) the Government realizes state policy in the field of physical culture and sport, coordinates their development with mediation of bodies of the central public management, and also cooperates with bodies of local public authority.
