Chapter I. General provisions

Article 1. Purpose and scope

(1) This law establishes the legal base for regulation of the sector of gardening by adoption of specific rules of laying of garden plantations, production, conversion and placement in the market of products of gardening.

(2) the Purpose of this law is providing the favorable regulatory base for increase in production and productivity of garden cultures for the purpose of support and stimulation of receipt of high-quality products of gardening with use of the available resources and on steady conditions.

Article 2. General purposes of the law

(1) General purposes of this law are:

a) performance improvement of the sector of gardening by stimulation and promotion of use of advanced technologies, diversification of crops and implementation of investments into infrastructure;

b) strengthening of capacity of the sector of gardening for production of safe and harmless products.

(2) for the purposes of this law the sector of gardening includes splits on cultivation of fruit, nuciferous crops, fruit bushes and strawberries, vegetables, mushrooms, essential, drug and aromatic oilbearing plants.

(3) Operation of this law does not extend:

a) on activities for cultivation of the plants containing narcotic or psychotropic substances;

b) on production and consumption of plant substances, medicines and medicines.

Article 3. Basic principles

Development of the sector of gardening is based on the following basic principles:

a) ensuring food security - development of the sector of gardening is aimed at providing enough foodstuff due to increase in the internal offer and import substitution;

b) compliance to the quality standards and safety of foodstuff - products of gardening conforms to the quality requirements established for it and safety;

c) diversification and adaptation to requirements of the foreign markets - products of gardening is capable to meet the specific requirements of the foreign markets, including preferences concerning assortment, packagings and markings;

d) stability and efficiency - development of the sector of gardening is based on the steady farming practices oriented to protection of natural resources and their effective use;

e) consumer focus - development of the sector of gardening is performed taking into account preferences and consumer requirements, offering them quality and safe products;

f) prevention and fight against irrational use of foodstuff - the sector of gardening develops so that to promote reducing irrational use of foodstuff by effective management of production and distribution of products of gardening.

Article 4. Basic concepts

For the purposes of this law the following basic concepts are used:

1) agricultural activities - activities according to the definition given in the Law on subsidizing of agricultural industry and the rural zone No. 71/2023;

2) the gardening area - the geographical zones intended for cultivation of garden cultures, representing separate categories of land fund;

3) nuciferous cultures - the cultures including the following types of nuts: Persian walnut, black walnut, almonds, hazel (filbert), edible chestnut and black fox;

4) gardening - the crop production industry including subindustries on cultivation of fruit and nuciferous crops, fruit bushes and strawberries, vegetables, mushrooms, essential, drug and aromatic oilbearing plants;

5) essential, drug and aromatic oilbearing plants - the types of plants cultivated or wild-growing, having on the chemical composition phytotherapeutic and aromatic properties, used fully or partially in fresh or dried type for production of finished goods in the preventive, medical, rehabilitation, food, flavoring or perfumery purposes;

6) system of cultivation - set of methods, technologies and the principles of the organization of use of the earth for cultivation of agricultural plants, including garden cultures determined by specific edaphic-climatic, economic and technology conditions of the region;

7) zoning of garden cultures - territorial differentiation and distribution of types, grades, hybrids and sortopodvoyny combinations according to climatic, economic, social and nature protection factors so that to provide optimal conditions for use of natural potential production of garden cultures.

Chapter II. Institutional base in the sector of gardening

Article 5. Development and promotion of state policy in the sector of gardening

(1) develops State policy in the sector of gardening and advances the Ministry of Agriculture and the food industry.

(2) the Ministry of Agriculture and the food industry performs the following powers:

a) development the politician in the sector of gardening, and also the regulations necessary for regulation of this sector;

b) introduction of offers concerning public the politician of development of the sector of gardening and drafts of the regulations necessary for regulation of this sector;

c) development of programs of financing industry politician;

d) development of measures and mechanisms of subsidizing;

e) conditioning for integration of products of gardening into chain of value added and increase in its cost;

f) the organization and coordination of the activities necessary for simplification of access for farmers to high-quality agricultural means of production, and also for development of infrastructure of production of gardening;

g) conditioning for improvement of access of domestic production of gardening to the internal and export markets;

h) conditioning for reduction of system of researches, education, consultation in the field of agricultural industry and development of the rural zone in compliance with priorities of the sector of gardening;

i) promotion and support practician of merging of producers of the sector;

j) promotion and support of proper domestic agricultural practices.

Article 6. Realization of state policy in the sector of gardening

(1) Realization of state policy in the sector of gardening is provided to Bureau of gardening which founder is the Ministry of Agriculture and the food industry.

(2) the Bureau of gardening is public organization with the status of the legal entity which charter, the structure and numerical structure affirm the Government.

(3) the Bureau of gardening performs the following main powers:

a) advances gardening products in the internal and export markets;

b) carries out industry analyses, marketing researches and develops economic arguments concerning requirements of development of the sector of gardening;

c) evaluates and monitorirut potential production, including bookmark and vykorchevka of plantations of garden cultures;

d) promotes implementation and distribution of innovations and modern technologies in the sector of gardening;

e) attracts and implements the projects and programs financed with assistance of partners in development, directed to promotion of products of gardening;
