On regulation of specific mode of creation and activities of the park of high technologies "Moldova HiTech Park"
Considering need of strengthening of innovative ecosystem and economic development on the basis of researches and technologies, in view of requirements of transition to digital, "green" and competitive economy,
The parliament adopts this organic law.
Art. 1. - This law establishes the special provisions regulating process of creation of the park of high technologies "Moldova HiTech Park" (further - the Park), and also its activities taking into account the privileges provided by the state, for the purpose of strengthening of potential in the field of research and development, increase in rates of implementation of technology innovations and stimulation of the economic development based on knowledge.
Art. 2. - The park is created for a period of 30 years with assignment to it the status of the industrial park of category B in the value provided by the Law on industrial parks No. 182/2010.
Art. 3. - The park specializes in such areas as information and communication technologies, business services and business process outsourcing, the creative and digital industries, financial services, the advanced engineering developments, microelectronics and semiconductors, the medical industry, green and environmentally friendly technologies, research and development, transfer of technologies, and also high and advanced technologies, including artificial intelligence, science about data and the analysis of big data, robotics, high-productive calculations (HPC), the Internet of prophetic (IoT) added / virtual reality, cyber security and bioengineering, and also in other innovative areas which can arise during activities of the Park.
Art. 4. - The park is created on the parcels of land of 50 hectares which are subject to forming by their transfer from the public sphere of the state to the private sphere of the state and their differentiation as a part of the parcels of land with cadastral number 3153201.336 by Ploshchad 100,5223 of hectare and according to cadastral number 3153201.005 Ploshchad 24,4042 of hectare, Steuchen located behind city boundaries, with forming of new real estate units.
Art. 5. - Government the resolution on assignment to managing enterprise of the status of the industrial park:
1) transfers the parcels of land from the public sphere of the state to the private sphere of the state;
2) transfers the parcels of land to managing enterprise of the Park in the following procedure:
a) 40 hectares - in free use (under the agreement of free use) for a period of 30 years;
b) 10 hectares - on the property right as non-cash contribution to the authorized capital.
Art. 6. - In departure from provisions of Articles 33, 58 and 59 Land codes No. 22/2024 and parts (2) article 77 of the Town-planning and construction code No. 434/2023 change of purpose of the parcels of land specified in article 4 of this law by their transfer from category of lands (including especially valuable lands) agricultural purpose in category of the lands intended for construction and arrangement is performed by the order of the Government at the request of the Agency of public property based on the petition with appendix of the cadastral plan of the parcel of land and in the presence of the consent of local council of the city of Steuchen to change of purpose of the parcels of land. Differentiation, forming of real estate units and cadastral registration of the lands allocated under creation of the Park are performed in first-priority procedure, with departure of aggregate terms, stipulated by the legislation.
Art. 7. - The resolution on assignment to managing enterprise of the Park of the status of the industrial park affirms the Government according to the offer of the Ministry of Economic Development and digitalization in departure from part provisions (2) Article 8 and article 10 of the Law on industrial parks No. 182/2010.
Art. 8. - The managing enterprise is limited liability company as which founders act the Agency of public property, local body of the public power in which administrative-territorial borders the parcel of land, and also higher educational institutions of technical and medical profile is located.
Art. 9. - In departure from provisions of Articles 18, 19 and 23-1 Laws on industrial parks No. 182/2010:
a) for receipt of resident status of the industrial park the job seeker shall show capability to perform activities in the areas of specialization of the Park specified in Article 3, and the capability to promote goal achievement of the Park, and also to correspond to the selection criteria of residents established by provision, stipulated in Item b);
b) selection of residents of the Park is performed by managing enterprise based on own provision approved by council of managing enterprise;
c) both residents of the Park, and managing enterprise of the Park can sign agreements of subhiring with the third parties for the purpose of temporary or specialized use of the rooms belonging to them and technical infrastructure for carrying out researches, transfer of technologies, testing, developmental developments, production, rendering business services, and also for implementation of other types of activity connected with the Park purposes without the need for availability at such third parties of official resident status of the Park;
d) the managing enterprise of the Park has the right to perform activities for construction of buildings of commercial appointment, such as office buildings, multi-purpose halls for the organization and holding scientific conferences and other actions, subjects to placement, for the purpose of ensuring needs of residents of the Park and the third parties specified in Item c) and also for receipt of the income necessary for realization of the purposes of the Park.
Art. 10. - For the purpose of providing optimal conditions for creation, development and activities of the Government Park through industry central bodies of the public power, and also the local authorities of the public power acting as founders of managing enterprise within the available powers and opportunities help:
a) to designing and construction of the sidings and networks of public transport necessary for connection of the Park to automobile, railway and city or long-distance transport infrastructure;
b) to ensuring connection to networks of engineering support (electric utility service, natural gas, water supply, the sewerage, networks of electronic communications), including by joint financing of works on expansion or upgrade of the accompanying engineering infrastructure;
c) to provision according to the tax and budget legislation of privileges in the form of exemption or decrease in the size of the local taxes and charges applied to the goods and services used for improvement and ensuring activities of the Park;
