About public service of sanitary cleaning

Chapter I. General provisions

Article 1. Subject and scope of the law

(1) This law establishes unified legal and institutional basis for creation, the organizations, managements, financings, monitoring and control of functioning of public service of sanitary cleaning in settlements, including administration and operation of the infrastructure connected with this service.

(2) Provisions of this law are applied to public service of the sanitary cleaning in settlements created and organized at the level of villages, communes, the cities, municipiums under management, coordination, control and responsibility of bodies of local public authority.

Article 2. Concepts

For the purposes of this law the following concepts are used:

1) association of intercommunitarian development which object of activity is the public service of sanitary cleaning - the association of intercommunitarian development in the value determined by the Law on associations of intercommunitarian development No. 17/2023, of which object of activity is creation, the organization, financing, operation, monitoring and management of public service of sanitary cleaning within competence of administrative-territorial member units, and also joint implementation of the public investment projects of regional value directed to creation, upgrade and/or on circumstances development of public system of the sanitary cleaning relating to this service;

2) biological waste - in the value determined by the Law on waste No. 209/2016;

3) collection - in the value determined by the Law on waste No. 209/2016;

4) separate collection - in the value determined by the Law on waste No. 209/2016;

5) the agreement on delegation of management - the written agreement by means of which administrative and territorial units delegate for certain period to the operators/operators acting on the risk and under the responsibility, the right and obligation to render public service of sanitary cleaning in full or on circumstances to provide only certain types of activity, specific to service, including the right and obligation on administration and operation of the infrastructure connected with the provided service or the performed activities, in exchange on compensation. The agreement on delegation of management can be signed by association of intercommunitarian development which object of activity is the public service of sanitary cleaning, from name and at the expense of administrative-territorial member units. The agreement on delegation of management is the administrative agreement and falls under action of provisions of the Administrative code;

6) delegation of management of public service of sanitary cleaning (further - delegation of management) - action by means of which the administrative and territorial unit awards to one or several operators according to this law the right to render public service of sanitary cleaning or the type of activity which is its component and for which the operator bears complete responsibility. Delegation of management provides implementation of public service of sanitary cleaning / type of activity, provision in the order of system of the sanitary cleaning relating to the delegated service / to the delegated type of activity and also the right and obligation of the operator to administer and operate the corresponding system of sanitary cleaning. Delegation of management can be also performed by associations of intercommunitarian development which object of activity is the public service of sanitary cleaning, from name and at the expense of administrative-territorial member units based on the special order of their authorized bodies;

7) deratization - the measure for fight against rodents directed to restriction or complete deprivation of rodents of possibility of penetration into the habitat and the production circle of the person;

8) disinfection - removal or destruction of microorganisms, causative agents of infectious and invasive diseases in the external environment;

9) disinsection - the measure for fight against insects directed to decrease in their number and prevention of diseases;

10) municipal waste - in the value determined by the Law on waste No. 209/2016;

11) performance indicators - the parameters of public service of sanitary cleaning observed by the operator of service for which the minimum levels of quality traced at the level of the operator are established;

12) the operator - the legal entity of public or private law with the state, private or mixed capital which is capable to provide public service of sanitary cleaning and to provide direct administration and operation of public system of sanitary cleaning according to provisions of this law;

13) the regional operator - the operator organized in the form of commercial society which authorized capital completely belongs to one or several administrative and territorial units which provides rendering public service of sanitary cleaning within competence of administrative-territorial founder units, including administration and operation of systems of sanitary cleaning. The regional operator can be also given authority on program implementation of investment into the infrastructure connected with public service of sanitary cleaning, performed together with administrative-territorial founder units;

14) collection point - specially equipped territory equipped with dustbins/containers for separate collection of municipal waste of users to which access of vehicles of special purpose for collection of waste is provided;

15) compensation - the payment for transfer to use of the property of the public or private sphere of administrative and territorial unit connected with public service of sanitary cleaning, established in the agreement on delegation of management;

16) complex management system municipal waste - in the value determined by article 2 of the Law on waste No. 209/2016;

17) sanitary cleaning - set of the transactions and actions necessary for providing the net environment of settlements;
