About the rights and guarantees of persons with disability

Chapter 1. General provisions

Article 1. Basic concepts and determinations

In this Law the following concepts are applied:

1) abilitation - package of measures, directed to forming and development absent since the birth at persons with disability of skills for implementation of household, public, professional and other work by them for the purpose of their inclusion in society;

2) adapted and/or special workplaces - the workplaces equipped taking into account individual opportunities and needs of persons with disability;

3) adapted literature - the educational, art, scientific, periodic and other publications on paper, electronic or other media adapted for perception and use by their persons with disability;

4) adapted (specialized) transport - the any kinds of vehicles equipped with special devices for access and use by their persons with disability;

5) discrimination on the basis of disability - any distinction, exception, isolation or restriction on the disability reason, the purpose or which derogation or denial of recognition, realization or implementation on an equal basis with others is result of all rights and fundamental freedoms of the person in political, economic, social, cultural, civil or any other sphere;

6) access to infrastructure - possibility of persons with disability of all categories it is free and safe to move on the territory of the Kyrgyz Republic, to have access to buildings and constructions and to use public transport, pedestrian sidewalks, highways, means of communication and other technical means of public use, including ATMs and payment terminals;

7) disability - the condition arising owing to permanent physical, mental, intellectual or touch violations which in case of interaction with various barriers in the environment interfere with complete and equal participation of person in life of society;

8) the individual program of rehabilitation and abilitation - the document determining the package of measures of rehabilitation or abilitatsionny services on the basis of assessment of condition of person with disability including separate types, forms, terms and amounts of medical, pedagogical, social and other types of the actions directed to recovery of the broken, lost functions or skills which are absent since the birth;

9) infrastructure - set of residential, office and other buildings, constructions, pedestrian sidewalks, highways, public transport, means of communication and other technical means in the territory of the Kyrgyz Republic;

10) quoting - setting standards of obligatory participation of persons with disability in various fields of activity for the purpose of their social support;

11) person with disability - person with long permanent physical, mental, intellectual or touch violations which in case of interaction interfere them with various barriers it with complete and effective participation in life of society on an equal basis with others. The status of disability is established by authorized state body by assignment I, II or III groups of disability or category "the child with disability" for children up to 18 years;

12) medico-social examination - complex assessment of extent of the restrictions of activity of osvidetelstvuyemy person caused by permanent disorder of functions of organism and also determination of his needs for measures of social protection, including rehabilitation and abilitation;

13) the international classification of functioning, restrictions of activity and health - classification of components of health, restriction of activity and functioning, the tool for assessment of disability and programs of rehabilitation;

14) the organization of persons with disability - the non-profit organization created on the basis of voluntary self-government by physical and (or) legal entities for protection of the rights and interests of persons with disability, improvements of their quality of life and assistance to their complete inclusion in society. Such organization shall correspond to one of the following criteria:

1) it is headed by person with disability;

2) at least 51 percent of founders are faces with disability;

3) at least 51 percent of staff of the organization make faces with disability;

4) main objective of the organization is protection of the rights of persons with disability and (or) improvement of their social and economic conditions.

The organization does not pursue revenue generating purpose, and any got profit goes only for achievement of the authorized purposes and is not distributed between members;
