About modification of some regulations
The Parliament adopts this organic law.
Art. I. - In the Criminal code of the Republic of Moldova No. 985/2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, Art. No. 72-74, 195), with subsequent changes to make the following changes:
1. Item c) parts (Article 78 to declare 1) invalid.
2. In Article 91:
part (to state 5) in the following edition:
"(5) Person serving sentence in the form of life imprisonment can be conditionally ahead of schedule exempted from punishment if the degree of jurisdiction establishes lack of need for further serving sentence based on assessment which considers accomplishment of the individual program of execution of the punishment, proper conduct during detention, active participation in paid or unpaid activities, except for situations when it does not depend on will of person, full recovery of the damage caused by crime for which person was condemned, except as specified, when person proves impossibility of its compensation, and also low risk of recurrence which forms the basis for release before complete departure of punishment. Person shall leave at least 30 years of imprisonment without preferential offsetting of the working days and other instruments of reducing punishment.";
add Article with parts (5-1) and (6-3) following contents:
"(5-1) In case of application of parole from punishment according to part provisions (5) this Article the degree of jurisdiction orders use of term of probation or on circumstances of probation period and obliges the convict to fulfill one or several obligations from among provided by part (6) Article 90. From the date of conditional release the convict is subject to supervision from body of probation for the term of 10 years.";
"(6-3) Provisions of parts (1), (3), (4) and (6) are not applied to person condemned to life imprisonment, punishment to which was replaced with imprisonment under the act of amnesty or pardon.".
