About introduction of amendments to the Law on control of compliance to quality requirements for fresh fruit and vegetables No. 237/2018

The parliament adopts this ordinary law.

Art. I. - In the Law on control of compliance to quality requirements for fresh fruit and vegetables No. 237/2018 (The official monitor of the Republic of Moldova, 2018, Art. No. 486-498, 813) to make the following changes:

1. To add formula of harmonization with words ", and also partially shifts Executive regulations of the Commission (EU) 2023/2430 of August 17, 2023 about establishment of rules of check of compliance to market standards for the sector of fruit and vegetables, for separate types of products of conversion of fruit and vegetables, and also for the sector of bananas, published in the Official magazine of the European Union by L 2023/2430 of November 3, 2023, CELEX: 32023R2430.".

2. In article 4 "business entity" to state concept of the following edition:

"business entity - physical person or legal entity, including groups of producers, which:

a) owns products of the sector of fruit or vegetables on purpose:

- demonstrations or exposure to sale;

- sales;

- realization in a different way; or

b) actually performs any of specified in Item a) the types of activity relating to sectors and products to which market standards extend.

The types of activity specified in Item a), include:

a) remote sale, including on the Internet;

b) the activities performed by physical person or legal entity on its own behalf or on behalf of the third party;".

3. In part (2) Article 5 of the word "ministry, responsible for industry of agricultural industry." shall be replaced with words "The Ministry of Agriculture and the food industry.".

4. In Article 6:

part (to add 3) with Items g) and h) the following content:

"g) information on sectors in which activities, or about products which are sold are performed;

h) information on availability or lack of any of the certificates and on term specified in Articles 15 or 151 for which they are issued.";
