About management of crisis situations
The parliament adopts this organic law.
This Law will partially be approved with the Decision of the European parliament and Council No. 1313/2013/EU of December 17, 2013 about the mechanism of civil protection of the Union (the text concerning EEP) published in the Official magazine of the European Union by L 347 of December 20, 2013, CELEX: 32013D1313, with the subsequent changes made by the Decision of the European parliament and Council (EU) 2023/2671 of November 22, 2023.
(1) This law establishes the legal base for ensuring management of crisis situations and determines procedure and coordination of the measures taken by bodies of the public power and public organizations, economic operators and non-profit organizations for the purpose of providing the prevention, preparation, reaction and recovery in the conditions of crisis situations for the benefit of protection of the population, public order and other spheres of homeland security.
(2) Provisions of this law do not extend to crisis situations which can lead to the announcement of obsidional or warlike situation.
(3) This law is applied to all subjects of public and private law in the Republic of Moldova.
For the purposes of this law the following basic concepts are used:
1) incident - the situation caused by natural or technogenic danger or threat of low scale and intensity which can pose hazard to life and human health, material and non-material values, the environment, national economy, safety of deliveries of paramount goods and services to the population, public order or other spheres of homeland security, but which does not correspond to criteria for recognition by its emergency situation yet;
2) emergency situation - incident or risk of emergence of incident at the national, territorial or local level, moderate intensity and the scale which threatens life and human health, material values, the environment, national economy, safety of deliveries of paramount goods and services to the population, public order or homeland security;
3) crisis - internal or external emergency situation which scale and intensity of effects in the territory of the Republic of Moldova are so high that cannot be controlled or be eliminated with use of resources available the main organization, and require decision making and institutional coordination at the national level;
4) serious crisis - the crisis of considerable scale and intensity caused by natural or technogenic danger, including catastrophic crash, or threat to homeland security capable to destabilize society or to create inevitable threat of life and to health of large number of people or to cause serious damage to national economy, property or the environment;
5) crisis situation - the process including any situation / state, caused by incidents, emergency situations, crises or serious crises;
6) catastrophic crash - the severe violation of functioning of community or society causing large-scale human, material, economic or ecological losses which exceed capability of the mentioned community or society to cope with situation, using own resources;
7) management of crisis situations - set of the strategic, organizational, institutional and operational measures performed in the integrated and coordinated form competent authorities of the public power and public organizations at all stages of crisis (prevention, preparation, reaction and recovery), for the purpose of reduction of impact and effects of the corresponding situation by the population, the environment, property and the constitutional system;
8) command and control - the right of the subject to issue obligatory orders for bodies of the public power and public organizations, and also for subordinate personnel and on circumstances to delegate this power properly, to allocate human and material resources for mitigation of consequences of crisis situations, and also to exercise supervision of accomplishment of the issued orders;
9) coordination - activities for synchronization and integration of actions, obligations and command structures for the purpose of ensuring effective use of human and material resources for response to crisis situation;
10) the main organization - body of the public power or the public organization appointed according to the National management plan crises in quality of the owner of risk, actionees, coordination and management of all actions for management of crisis situations;
11) auxiliary organization - body of the public power or the public organization appointed according to the National management plan crises to which duties rendering any form of support to the main organization in accomplishment of functions of the early prevention, prevention, preparation, reaction and/or recovery after crisis situations belongs;
12) evacuation - temporary movement of persons from certain territory, the site or from the real estate unit, including to other country, with use of humanitarian corridors, mechanisms of transit or other coordinated ways, for the purpose of rescuing of lives as a result of emergence of incident, emergency situation or crisis;
13) the early warning of crisis situations - the process of assessment, monitoring and the notification about risks of emergence of crisis situations which is within the remit of body of the public power or public organization;
14) the action plan on case of incident, emergency situation or crisis - the document developed by bodies of the public power and public organizations, and also economic operators in which necessary actions for incident management, are described by emergency situations or crises;
15) risk - the manifestation of uncertainty concerning emergence of incident, emergency situation or crisis determined by probability of realization of threat and extent of impact of its effects on homeland security;
16) risks assessment - process of identification of risks, their analysis and assessment of impact, and also probability of their origin;
17) national risks assessment - periodically performed process of the analysis of the dangers and threats capable to cause crises;
18) risk indicators - the physical, chemical, geographical, economic, medical, social or other measured parameters traced by means of methods of observation and scientific calculations which in real time reflect inevitability of emergence of risk or extent of impact and intensity in case of its origin;
19) criteria of crisis situations - the physical, chemical, geographical, medical, social or other indicators traced by means of methods of observation and scientific calculations by means of which the scale and intensity of event for the purpose of determination of the threshold values characterizing emergency situation is measured;
20) the National risk register - the document of national risks assessment containing the hierarchical description of the most significant risks capable to lead to emergence of crisis situations, with indication of the main and auxiliary organizations and bodies responsible for preparation and reaction in case of their origin;
21) the vital functions of the state - the functions exerting the determining impact on functioning of the state which violation poses threat of life or to human health or causes serious damage to economy, the environment, public order and homeland security;
22) going concern - capability of body of the public power or public organization or economic operator to provide consecutive and effective implementation of the functions in situations which can lead to interruptions in activities;
23) continuity of public administration - capability of the state to provide smooth functioning of bodies of executive, legislative and judicial authority, and also to perform the vital functions during the period preceding crisis during crisis and after its origin;
24) the learned lessons - the specific measures realized by bodies of the public power and public organizations on the basis of the previous experience got during management extraordinary or crises for the purpose of increase in degree of resistance to future emergency situations and crises;
25) system of the prevention - set of organizational and technical measures for monitoring of risks and to the notification of the population, bodies of the public power and public organizations, and also economic operators about origin or inevitable threat of emergence of crisis situation;
26) system of the institutional early prevention - the part of system of the prevention including monitoring of risk of emergence of crisis situations, the institutional notification about origin or inevitable threat of their origin and also reduction of organizations in the increased operational readiness depending on extent of inevitable threat, intensity or impact of such situations;
27) the population warning system - the part of system of the prevention including set of organizational and technical measures for bringing to data of the population of necessary information on inevitable threat of emergence of crisis situation with the purpose of prevention of effect of suddenness and acceptance of necessary measures of protection;
28) public informing the population in crisis situations - providing transparent and continuous flow of up-to-date and reliable information before origin, in time and after crisis situation about measures of preparation for crisis situations, their development, measures taken by authorities about the arisen effects and recommendations about actions for the population;
29) individual emergency inventory - set of the necessities allowing the person to provide independently survival during crisis;
