About modification of some regulations (assessment of activities of judges and prosecutors)
The Parliament adopts this organic law.
Art. I. - In Item d) parts (1) article 233 of the Law on judicial system No. 514/1995 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 15-17, 62), with subsequent changes to exclude the words "also deprives of them powers".
Art. II. - Part (5) article 6 of the Law on the status of the judge No. 544/1995 (repeated publication: 2013, 63), with subsequent changes to state the official monitor of the Republic of Moldova to Art. No. 15-17, in the following edition:
"(5) person having length of service in judgeship at least four years can apply For judgeship of Appeal chamber. Conditions of position assignment of the judge of the Highest trial chamber are established in the Law on the Highest trial chamber No. 64/2023.".
Art. III. - In the Law on the Supreme council of magistracy No. 947/1996 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 15-17, 65), with subsequent changes to make the following changes:
1. Part (Article 4 to add 1) with Item with 1) of the following content:
"with 1) disposes once about carrying out repeated assessment of activities of judges, chairmen and deputy chairmen of degrees of jurisdiction;".
2. In part (1) Article 5 the second offer to exclude.
3. To add the Item d 1) of article 6 after the words "and in official journeys" with words ", and also orders about provision of leaves to chairmen and deputy chairmen of degrees of jurisdiction".
4. Part (Article 22 to state 3) in the following edition:
"(3) Claims to the decisions made by Board on selection and assessment of judges are considered according to provisions of the Law on selection of judges and assessment of their activities No. 147/2023.".
