About modification and amendments in some orders of the Minister of Finance of the Republic of Kazakhstan

1. Bring in the order of the Minister of Finance of the Republic of Kazakhstan of September 26, 2024 No. 646 "About approval of Rules of forming and maintaining registers in the field of public procurements" (it is registered in the Register of state registration of regulatory legal acts at No. 35143) the following changes and amendment:

in Rules of forming and maintaining registers in the field of the public procurements approved by the specified order:

44, 44-1, 45 and 46 to state Items in the following edition:

"44. Requests of potential suppliers about entering into the Register of work experience of the data and documents confirming work experience on installation and construction works for the last 10 (ten) years, preceding the current year and also for the current year, on objects where customers are public institutions and source of financing are the state investments are considered taking into account the following requirements:

1) reliability of the data and documents confirming work experience of the potential supplier as the prime contractor is determined on the basis of these bodies of treasury. At the same time, in the absence of data and documents in information system of treasury, such data are considered according to requirements, stipulated in Item 45 these rules;

2) reliability of the data and documents confirming work experience of the potential supplier as subcontractor is determined on the basis of the data and documents confirming work experience of the potential supplier having work experience in quality of the prime contractor with the status "Is confirmed";

3) compliance of the documents confirming work experience of the potential supplier to requirements according to Item 46 of these rules.

44-1. Requests of potential suppliers about entering into the Register of work experience of the data and documents confirming work experience on installation and construction works for the last 10 (ten) years, preceding the current year and also for the current year, on objects where customers are subjects of the quasi-public sector and source of financing are the state investments, are considered taking into account the following conditions:

1) the data and documents confirming work experience of the potential supplier as the prime contractor prove to be true:

the customer (in case of reorganization – the customer's legal successor);

the body exercising the state architectural construction supervision.

Confirmation is performed by the above-stated bodies and persons based on addresses of the potential suppliers provided by means of the web portal with use of the digital signature;

by means of the single portal of complex non-departmental examination of projects regarding the positive conclusion of complex non-departmental examination of projects;

2) reliability of the data and documents confirming work experience of the potential supplier as subcontractor is determined on the basis of data and confirming work experience in quality of the prime contractor with the status "Is confirmed";

by means of the single portal of complex non-departmental examination of projects regarding the positive conclusion of complex non-departmental examination of projects;

3) compliance of the documents confirming work experience of the potential supplier to requirements according to Item 46 of these rules.

45. Requests of potential suppliers about entering into the Register of work experience of the data and documents confirming work experience on installation and construction works (new construction of buildings and constructions) of the objects carried to technically and (or) technologically difficult, and also, their complexes, engineering and transport communications for the last 10 (ten) years preceding the current year and also for the current year on objects where customers are non-state legal entities are considered taking into account the following conditions:

1) the data and documents confirming work experience of the potential supplier prove to be true:

the body exercising the state architectural construction supervision based on addresses of the potential suppliers provided by means of the web portal with use of the digital signature;

by means of the single portal of complex non-departmental examination of projects regarding the positive conclusion of the state complex non-departmental examination of projects;

2) compliance of the documents confirming work experience of the potential supplier to requirements according to Item 46 of these rules.

46. Documents, confirming work experience on installation and construction works, are:

1) the electronic copy of the acceptance act of construction object in operation, in form of article 20 of the Law of the Republic of Kazakhstan approved according to subitem 22-2) "About architectural, town-planning and construction activities in the Republic of Kazakhstan" (further – the Law on architectural, town-planning and construction activities), except for objects of the current, average repairs, and also objects accepted in operation by the owner independently;

2) the electronic copy of the act of the performed works, in form of article 20 of the Law on architectural, town-planning and construction activities approved according to subitem 23-17);

3) the electronic copy of the declaration of conformity in form of article 20 of the Law on architectural, town-planning and construction activities approved according to subitem 22-1) or the conclusion of the worker of the commission operating till January 1, 2016;

4) the electronic copy of the coupon about acceptance of the notification on the beginning of installation and construction works in form of article 11 of the Law of the Republic of Kazakhstan approved according to the subitem 4) "About permissions and notifications" (further – the Law on permissions and notifications);
