About ensuring traceability of water bioresources and/or products made from water bioresources

This Law determines the main legal, economic and organizational basis of traceability of water bioresources and/or products made from the water bioresources which are in circulation in the territory of Ukraine, imported (sent) on customs area of Ukraine or exported (sent) of it.

Section I. GENERAL PROVISIONS

Article 1. Determination of terms

1. In this Law the stated below terms are used in the following value:

1) alfa-3 code of accounting by services of the Food and Agriculture Organization of the United Nations of products of industrial fishery and aquaculture in the world (further - alfa-3 code of FAO) - the unique code from three Latin letters appointed accidentally or connected with the Latin or English name of type used for classification of water bioresources for the purpose of further exchange of statistical information between the international fisheries management organizations;

2) cargo batch of traceable water bioresources and/or products made from water bioresources (further - cargo batch), - the load consisting of one or several batches of water bioresources and/or products made from the water bioresources received as a result of implementation of transactions with objects of industrial fishery, batches of water bioresources and/or products made from the water bioresources received as a result of implementation of transaction with aquaculture objects.

Such load is transported by one vehicle from one consignor to one or several consignees on one or several specialized commodity-transport delivery notes for traceable water bioresources and/or products from them or according to other international transport document defined by international treaties which party is Ukraine in case of transportation of batch of water bioresources and/or products made from the water bioresources received as a result of implementation of transactions with objects of industrial fishery, production (catch) of which was performed outside jurisdiction of Ukraine, and/or import of traceable water bioresources and/or products made from water bioresources;

3) the ranking officer - the employee of production structural division of the subject of fishery or production structural division of the subject of aquaculture responsible for getting (catch), unloading of water bioresources, internal transfer and introduction of information on traceable water bioresources and/or products made from water bioresources in electronic system of traceability of water bioresources and/or products made from water bioresources;

4) the ranking officer of rybopriyemny Item - the worker responsible for acceptance, accounting of water bioresources and lot identification of water bioresources appointed the subject of fishery and/or products made from the water bioresources received as a result of implementation of transactions with objects of industrial fishery on rybopriyemny Item or the fishing boat (in case of implementation of production (catch) of water bioresources outside jurisdiction of Ukraine), and also entering of information into electronic system of traceability of water bioresources and/or products made from water bioresources, rather water bioresources and/or the products made, made from water bioresources;

5) water objects (their part), including technology devices for the purposes of aquaculture, - fishery water objects (their part), fishery technology reservoirs, water areas (water space) of internal sea waters, the territorial sea, exclusive (sea) economic zone of Ukraine, the technology devices and constructions used or provided in use for the purposes of aquaculture;

6) electronic system of traceability of water bioresources and/or products made from water bioresources (further - Electronic system), - the information and communication system which is component of the Single state electronic management system industry of fishery provides collection, processing, accumulating, use, generalization, accounting, storage, transfer, protection of information/data on transactions with traceable water bioresources and/or products made from water bioresources when implementing industrial fishery, pilot catch and activities of special commodity fishery, transaction with traceable water bioresources and/or products made from water bioresources during implementation of aquaculture and/or export-import transactions, re-export of traceable water bioresources and/or products made from water bioresources;

7) the online magazine of accounting of the subject of aquaculture - the component of Electronic system providing entering of traceability of information by the operator into Electronic system on transactions with traceable water bioresources and/or products made from water bioresources when implementing aquaculture, types and amounts of the got (caught) water bioresources;

8) the online magazine of accounting of the subject of fish economy component of Electronic system, providing entering of traceability of information by the operator into Electronic system on types and amounts of the got (caught) water bioresources, transactions with traceable water bioresources and/or products made from water bioresources when implementing industrial fishery, pilot catch and activities of special commodity fishery;

9) not ovulated calves - the calves received by method of mechanical department from connective tissue of ovaries (ova) of water bioresource;

10) the ovulated calves - the calves received from water bioresources at maturing stage by method of free department of berries from ovaries (ovaries) by intravital method;

11) the operator of traceability subject of managing performing economic activity in the field of traceability of water bioresources and/or products made from water bioresources including the first seller, the first buyer, the buyer, the consignor, the consignee, carrier, the ranking officer of rybopriyemny Item and the ranking officer.

Operators of traceability shall provide traceability of water bioresources and/or products from them according to requirements of this Law, and also to timely enter the authentic and complete data into the electronic system provided by this Law;

12) transactions with traceable water bioresources and/or products made from water bioresources when implementing industrial fishery, pilot catch and activities of special commodity fishery (further - transactions with objects of industrial fishery) - production (catch), unloading, acceptance, accounting, conversion, internal transfer, overload (in case of implementation of production (catch) of water bioresources outside jurisdiction of Ukraine), marking, transportation, sale, export-import transactions, re-export, retirement and utilization of traceable water bioresources and/or products made from water bioresources;

13) transactions with traceable water bioresources and/or products made from water bioresources during implementation of aquaculture (further - transactions with aquaculture objects) - production (catch), artificial culture (reproduction) of water bioresources, introduction, acclimatization, reacclimatization, providing recreational services in the field of aquaculture, unloading, acceptance, accounting, conversion, internal transfer, marking, transportation, sale, export-import transactions, re-export, withdrawal from the address and utilization of products of aquaculture;

14) batch of water bioresources and/or products made from the water bioresources received as a result of implementation of transactions with objects of industrial fishery (further - batch of industrial fishery), - traceable water bioresources and/or products made from water bioresources, certain amount (quantity), type, identical commodity form (dimensional characteristics and trade dress), one biological condition coming from one geographical area and one fishery water object (its part) got (caught) by one production structural division of the subject of fishery, unloaded and considered on rybopriyemny Item within one days from the moment of exit of the fishing boat from its place of basing or exit to production (catch) of water bioresources by their collection;

15) batch of water bioresources and/or products made from the water bioresources received as a result of implementation of transactions with objects of industrial fishery, production (catch) of which was performed outside jurisdiction of Ukraine (further - batch of the water bioresources got (caught) outside Ukraine), - traceable water bioresources and/or products made from water bioresources, certain amount (quantity), type, identical commodity form (dimensional characteristics and trade dress), one biological condition coming from one geographical area got (caught), processed according to transport number and considered by one fishing boat under National flag of Ukraine within a day when implementing trade outside jurisdiction of Ukraine;
