Bring in the constitutional Law of the Kyrgyz Republic "About election of the president of the Kyrgyz Republic and deputies of Jogorku Kenesh of the Kyrgyz Republic" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2011, No. 7, the Art. 971) the following changes:
Part 4 of Article 3 to state 1) in the following edition:
"4. Have no right to be elected to position of the President, deputy of Jogorku Kenesh of person:
1) having the criminal record including removed or extinguished;
Concerning which 2) criminal case is stopped on not rehabilitating bases, except for:
- crimes of small weight, less serious crimes committed on imprudence;
- cases of refusal of the private and public accusation which was injured from maintenance and (or) in case of achievement of consent of the person accused with the victim in the compliance and procedure provided by the penal legislation of the Kyrgyz Republic;
3) religious figures within 5 years after suspension of religious activities by them.";
2) in Article 46:
a) regarding 1 word "at it not removed or outstanding in the procedure for criminal record established by the law or" to exclude;
b) in part 4:
- in paragraph one of the word "about availability at it not removed or outstanding in the procedure for criminal record established by the law, entry into force of conviction of court concerning it" shall be replaced with words "about availability of the circumstances provided by part 4 Articles 3 presents of the constitutional Law";
- in the paragraph the second shall be replaced with words the words "about availability not removed or outstanding in the procedure for criminal record established by the law, entry into force of conviction of court concerning it" "about availability of the circumstances provided by part 4 Articles 3 presents of the constitutional Law";
