About the Unified state register of voters

Chapter I. General provisions

Article 1. The unified state register of the citizens of Turkmenistan having the voting right on elections and referenda

The unified state register of the citizens of Turkmenistan (further – the State register) having according to the Constitution of Turkmenistan and the Electoral code of Turkmenistan the voting right on elections and referenda (further – voters), is the centralized digital information system containing the information about voters provided by this Law, intended for storage, the data processing and use of them created for the purpose of ensuring the state accounting of voters.

Article 2. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) the database of the State register – set of the centralized data directed to obesyopecheniye of complete entering of information on voters into the State register according to the procedure, determined in this Law, their reliability, safety, maintaining it in single form by use of information and communication technologies, system of technical means, and also electronic system of exchange of information;

2) information of the State register – the personal data of voters, their selective address and data determining the place and conditions of their vote;

3) personal data of the voter – surname, name, middle name, birth date, the birthplace, floor, nationality, the selective address and the data determining the place and conditions of its vote;

4) the selective address of the voter – information on the permanent or preferential place of residence (registration) or on the place of temporary stay (registyoration) of the voter;

5) the body managing the State register (further – the manager of the State register), – the authorized body providing observance of requirements of this Law and control over activities for creation and maintaining the State register;

6) the groups keeping the State register (further – keeping the State register), – the groups providing maintaining the State register authorized to make in the database record about the voter, changes in its personal data.

Article 3. Main objectives of the State register

The main objectives of the State register are:

1) organization and accounting of personal data of voters;

2) creation of the electoral register for elections of the President of Turkmenistan, Medzhyolis's deputies of Turkmenistan, members Hulk of maslakhata of the welayat, the city with the rights of the welayat and the state value, the etrap, city with the etrap rights, Gengesha, national and local referenda.

Article 4. Main objectives of maintaining the State register

Main objectives of maintaining the State register are:

1) providing in the procedure for the state accounting of voters including complete and reliable information about voters, storage, processing of this information and its use determined in this Law;

2) ensuring compliance with the voting rights of citizens of Turkmenistan;

3) ensuring reliability and security of information of the State register.

Article 5. Principles of maintaining the State register

The principles of maintaining the State register are:

1) legality and priority of human rights in deyatelnosyot on maintaining the State register – guarantee human rights protection and the citizen, compliance of procedure for maintaining the State register of the Constitution of Turkmenistan, to the Electoral code of Turkmeniyostan, the laws and international treaties of Turkmenistan;

2) general nature of the State register – for the purpose of realization of universal adult suffrage provides entering of voters into the State register irrespective of their permanent or preferential residence (registration) or the place of temporary stay (registration);

3) completeness and integrity of information of the State register – provide entering into the database of the State register of complete amount of the information about the voter provided by this Law, their reliability, and also maintaining the database of the State register in single format;

4) accuracy of the information of the State register – is provided with availability at the personal data keeping the State register of documentary confirmation containing in the database of the State register, and also information about the bases for inclusion of the voter in the State register established by this Law or modification of personal data of the State register;

5) momentariness of inclusion of the voter in the State register – the voter can be included in the State register of voters only once to one selective address and is respectively carried to one polling precinct;

6) the permanency of the State register – predusmatyorivat lack of the term of its action established by the legislation irrespective of terms of elections or referenda, and also permanent storage of personal data of the State register (except the cases determined in part four of article 18 of this Law);
