About entering of amendments into the Customs code of Turkmenistan

Part the second articles 307 after paragraph one to add 1) with paragraphs of the following content:

"Risk management – activities of customs authorities for minimization of probability of approach of the events connected with non-compliance with international treaties and the customs legislation of Turkmenistan and possible damage as a result of these events.

Risk management system – complex of the actions performed by customs authorities for the purpose of identification and the prevention of risks when moving through customs border of Turkmenistan and customs clearance of goods, vehicles and persons and also concerning the documents used for the customs purposes.";

To add 2) after Article 307 with Article of the following content:

"Article 307-1. The risk management system applied by customs authorities

1. The purposes of application by customs authorities of risk management system are:

1) ensuring efficiency customs конт­роля by determination of risk level when moving through customs border of Turkmenistan and customs clearance of goods and vehicles, and also concerning persons;

2) prevention and identification of violations of the customs legislation of Turkmenistan;

3) creation of conditions on simplification and acceleration of movement through customs border of Turkmenistan of goods concerning which need of application of measures of risk minimization is not revealed.

2. The strategy of application by customs authorities of Turkmenistan of risk management system is determined by the Cabinet of Ministers of Turkmeniyostan.
