The purpose of this Law is regulation of the relations connected with registration at the place of residence and the place of stay of citizens of the Republic of Uzbekistan, foreign citizens and stateless persons.
The legislation on registration at the place of residence and the place of stay of citizens of the Republic of Uzbekistan, foreign citizens and stateless persons consists of this Law and other acts of the legislation.
If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about registration at the place of residence and the place of stay of citizens of the Republic of Uzbekistan, foreign citizens and stateless persons then are applied rules of the international treaty.
For the purpose of providing necessary conditions for realization of constitutional right of the citizens of the Republic of Uzbekistan, and also on legal causes who are in the territory of the Republic of Uzbekistan foreign citizens and stateless persons on free movement across the Republic of Uzbekistan, the choice of the place of stay and residence, other their rights and freedoms, and also execution of obligations by them before other persons, the state and society registration at the place of residence and the place of stay of citizens of the Republic of Uzbekistan, foreign citizens and stateless persons is performed (further - registration at the place of residence and the place of stay).
Registration at the place of residence and the place of stay has no allowing character.
Lack of registration at the place of residence or the place of stay at citizens of the Republic of Uzbekistan, foreign citizens and stateless persons is not the basis for restriction of their rights and freedoms if other is not stipulated by the legislation.
The residence is the apartment house, the apartment, office premises, the specialized house (the hostel, the house of temporary housing stock or the house boarding school for disabled people, veterans, lonely aged, and also orphanage or the house of other special purpose) or other premises in which person constantly (mainly) lives in quality of the owner according to the employment contract (subhiring), free use or on other bases, stipulated by the legislation and in which it is registered at the place of residence.
The place of stay is means of placement, medical institution or the premises which are not the residence of person in which person temporarily lives on the bases, stipulated by the legislation.
The residence of minors aged up to fourteen years or persons which are under guardianship the residence of their legal representatives - according to parents (single parent), adoptive parents or guardians is considered.
The residence of minors aged from fourteen up to sixteen years or persons which are under guardianship the residence of their legal representatives - according to parents (single parent), adoptive parents or custodians is considered.
In this Law the following basic concepts are used:
the child - person before achievement of age of eighteen years (age of majority);
the ward the child - the child concerning whom guardianship or custody is established;
medical institutions - sanatoria, medical boarding houses, the state and private clinics, clinics, hospitals and other medical institutions;
the single parent - the father (mother) who is bringing up the child provided that in official documents about the birth of the child of the information about one parent are absent or are brought according to the parent who is bringing up the child;
means of placement - hotels, tourist centers and complexes, houses and rest areas, boarding houses, campings, motels, guest houses, yurtovy and tent the camp, sanatoria and other objects in which hotel services (service in placement) are rendered;
the identification ID card (further - the ID card) - the identity document and nationality, registration of the owner of the ID card at the place of residence in the territory of the Republic of Uzbekistan containing the electronic medium (chip) with the entered personal bio and biometric data of its owner issued to the citizen of the Republic of Uzbekistan, the foreign citizen or the stateless person;
registration in the place of stay - fixing in accordance with the established procedure data on the place of stay of the citizen of the Republic of Uzbekistan, the foreign citizen or stateless person;
the stateless person - the person who is not the citizen of the Republic of Uzbekistan and not having the evidence of the belonging to nationality of foreign state;
the foreign citizen - the person who does not have nationality of the Republic of Uzbekistan, having nationality and the proof of the belonging to nationality (citizenship) of other state;
registration at the place of residence - fixing in accordance with the established procedure place of residence of the citizen of the Republic of Uzbekistan, the foreign citizen or stateless person who is constantly living in the Republic of Uzbekistan.
the citizen of the Republic of Uzbekistan who is constantly living abroad - the citizen of the Republic of Uzbekistan who drew up the exit visa abroad on permanent residence and at which registration at the place of residence in the Republic of Uzbekistan is cancelled;
travel documents - national passports, and also other documents replacing them based on which according to the legislation and international treaties of the Republic of Uzbekistan foreign citizens and persons without citizenship have the right to drive (to leave) and stay in the territory of the Republic of Uzbekistan;
the automated information system "E-mehmon" (further - the E-mehmon system) - the automated information system used in means of placement and medical institutions intended for implementation of registration of the persons living in means of placement or being on hospitalization in medical institutions in the place of stay in notifying procedure;
the automated information system "E-xabar Berish" (further - the E-xabar Berish system) - the automated information system intended for implementation of registration of persons in the place of stay in notifying procedure;
the automated information system "Manzil" (further - the Manzil system) - the automated information system intended for implementation of registration of persons at the place of residence.
Citizens of the Republic of Uzbekistan, foreign citizens and stateless persons shall be registered at the place of residence or the place of stay.
The owner of premises or the person having order rights premises, providing living space for accommodation of persons shall register timely these persons at the place of residence or the place of stay.
Registration of persons which are in means of placement in the place of stay in notifying procedure is performed by responsibles of means of placement by means of the E-mehmon system.
