About introduction of amendments to the Order of the Ministry of Finance of Ukraine of June 15, 2012 No. 731

According to Article 239 of Chapter 37 of the Section VII of the Customs code of Ukraine, the Law of Ukraine of August 22, 2024 to No. 3926-IX "About modification of the Customs code of Ukraine concerning implementation of some provisions of the Customs code of the European Union", the subitem 5 of item 4 of the Regulations on the Ministry of Finance of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 No. 375, I ORDER:

1. In heading and Item 1 of the order of the Ministry of Finance of Ukraine of June 15, 2012 No. 731 "About approval of the Procedure for expense recovery for storage of goods and vehicles in warehouses of customs authorities, the Procedure for calculation of expense amounts on cases on customs offense and their compensation and the Amount of compensations for storage in warehouses of customs authorities of goods and vehicles", the word "for storage of goods and vehicles in warehouses of customs authorities", "for storage of goods and vehicles in warehouses of customs authorities" registered in the Ministry of Justice of Ukraine on July 09, 2012 at No. 1140/21452, shall be replaced with words "customs authorities on survey of the goods and other expenses connected with movement of goods of warehouse of customs authority, and storage of goods and vehicles in such warehouse", "customs authorities on survey of the goods and other expenses connected with movement of goods of warehouse of customs authority and storage of goods and vehicles in such warehouse" respectively.

2. Bring in the Procedure for the expense recovery for storage of goods and vehicles in warehouses of customs authorities approved by the order of the Ministry of Finance of Ukraine of June 15, 2012 No. 731, registered in the Ministry of Justice of Ukraine on July 09, 2012 at No. 1140/21452, the following changes:

in heading of the word "for storage of goods and vehicles in warehouses of customs authorities" shall be replaced with words "customs authorities on survey of the goods and other expenses connected with movement of goods of warehouse of customs authority, and storage of goods and vehicles in such warehouse";

to state Item 1 of the Section I in the following edition:

"1. This Procedure determines the mechanism of expense recovery of customs authorities for survey of the goods and other expenses connected with movement of goods of warehouse of customs authority, and storage of goods, the vehicles specified in part seven of Article 239 of Chapter 37 of the Section VII of the Customs code of Ukraine in such warehouse (further - expenses).";

in the Section II:

in Item 2:

word in paragraph one "the owner of goods, vehicles or person authorized by it" shall be replaced with words "the holder of goods or other interested persons";

in paragraph three of the word "concerning covering of customs authority of expenses for storage of goods, vehicles" shall be replaced with words "the payer on covering of expenses";

in Item 3 of the word "expenses of customs authority on fee on transportation of goods and vehicles to the place of their storage and work of cargo handling machinery which was involved at the same time are actually incurred" shall be replaced with words "expenses of customs authority on survey of goods and other expenses connected with movement of goods of warehouse of customs authority which are calculated based on the source documents confirming such expenses";

in Items 6, to "owners or authorized persons" to exclude the 7th words;

in Item 9:

the paragraph one after the word "Expenses" to add with the words "for storage";

in paragraph three of the word "take place their owner or person authorized by him in" shall be replaced with words "are located with their holder in Customs";

state Item 10 in the following edition:

"10. Issue from warehouse of customs authority of goods, vehicles to their holder is performed only after customs clearance of the specified goods, vehicles, expense recovery and payment of the corresponding customs payments.";

in the Section III:

in Items 1, to replace 2 words of "customs authority for storage" with the word "relatively";

in Item 3 of the word to "the owner or person authorized by it" shall be replaced with words "from structure of customs authority", to "owners or authorized persons" to exclude words;

in Item 5 of the word to "the owner or person authorized by it" shall be replaced with words "from structure of customs authority";

in Item 6 of the word "for storage" to exclude;

in Item 7 of the word "for storage of goods, vehicles" to exclude, the words "their issues" shall be replaced with words "issues of the goods and vehicles which are temporarily withdrawn on the case of customs offense";

in the Section IV:

in Item 1 of the word of "customs authority for storage of goods, vehicles" to exclude;

state Item 2 in the following edition:

"2. The means received as expense recovery are used for covering of expenses.".

3. Bring in the Procedure for calculation of expense amounts on cases on customs offense and their compensation approved by the order of the Ministry of Finance of Ukraine of June 15, 2012 No. 731, registered in the Ministry of Justice of Ukraine on July 09, 2012 at No. 1141/21453, the following changes:

in Item 6 of the Section II:

the paragraph one after the words "belonging to customs authorities" to add with the words "or used by them";

in the paragraph the second shall be replaced with words the words "and placed in the warehouses used by customs authorities according to lease agreements or storages" "which because of the properties and/or bulkinesses were left on storage in the place of their detection / stay or transferred to storage to the companies in which warehouses necessary conditions for proper storage of such goods, vehicles are created";

to be reworded as follows appendix to this Procedure which is applied.

4. In accordance with the established procedure to provide to department of customs policy of the Ministry of Finance of Ukraine:

submission of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

5. This order becomes effective at the same time with entry into force of the Law of Ukraine of August 22, 2024 3926-IX "About modification of the Customs code of Ukraine concerning implementation of some provisions of the Customs code of the European Union", but not earlier than day of official publication of this order.

6. To impose control over the implementation of this order on the Deputy Minister of Finance of Ukraine concerning the European integration Draganchuk Yu. A. and Chairman of the State Customs Service of Ukraine.
