About introduction of amendments to the Code of Ukraine on insolvency proceedings concerning the measures directed to debt repayment, the electrical energy formed in the wholesale market

The Verkhovna Rada of Ukraine decides:

1. Bring in the Code of Ukraine on insolvency proceedings (Sheets of the Verkhovna Rada of Ukraine, 2019, No. 19, the Art. 74) such changes:

Part the sixth Article 39 to add 1) with the paragraph the fourth the following content:

"the application is submitted about initiation of proceedings about bankruptcy of the wholesale supplier of electrical energy";

Part the fifth Article 41 after the paragraph of the fifth to add 2) with the new paragraph of the following content:

"Operation of the moratorium does not extend to satisfaction of requirements of creditors for action of the procedure of debt repayment for outstanding amounts of participants of calculations, due for settlement on the conditions determined by the Law of Ukraine "About the measures directed to debt repayment, the electrical energy formed in the wholesale market".

With respect thereto to consider the paragraph of the sixth the paragraph the seventh;

3) in Article 90:

to add part one after Item 8 with new Item 9 of the following content:

"9) debtor is the wholesale electric power supplier".

With respect thereto to consider Items 9-13 respectively Items 10-14;

in part two of the word and figure "Items 2, of 3, of 5, of 9, 11 and 12 parts one of this Article" shall be replaced with words also in figures "Items 2, of 3, of 5, of 9, of 10, 12 and 13 parts one of this Article", and words and figures "Items 1, of 4, of 6, 8 and 10 parts one of this Article" - words and figures "Items 1, of 4, of 6, 8 and 11 parts one of this Article".

2. This Law becomes effective from the date of, its publication following behind day.
