About introduction of amendments to some Laws of Ukraine concerning implementation of regulations of the European Union law concerning electronic communications
The Verkhovna Rada of Ukraine decides:
I. Make changes to such laws of Ukraine:
1. In the Law of Ukraine "About electronic communications" of December 16, 2020 No. 1089-IX with the following changes:
Part the fifth Article 14 to state 1) in the following edition:
"5. In case of availability of proofs of violation of conditions of general authorization in the field of the electronic communications determined by article 18 of this Law, conditions, determined by articles 47 and 79 of this Law, and/or conditions of the license to use radio-frequency range that poses direct and serious threat for public safety, public safety, public health or risks of creation of serious economic or operational problems for other suppliers of electronic communication networks and/or services, users of radio-frequency range, users of electronic communication services, the regulatory body in the procedure established by it takes urgent temporary measures for elimination of the specified threats or risks for the period before acceptance of the final decision, in particular, by restriction of the rights to use provided by the license with radio-frequency range, including their suspension, or determinations of certain technical parameters of use of radio-frequency range.
Such measures are applied for the term which is not exceeding 20 working days.
If the specified actions are not complete in certain time, it can be extended by the decision of regulatory body, but no more than for three months.
Before acceptance of the measures provided by this part the regulatory body shall propose to subject of managing concerning which they are accepted, to provide at the scheduled time of explanation, and also to propose measures for elimination of the corresponding threats or risks";
